2010 Census; Constitutional or not ?

    Rep. Michele Bachmann, R-Minn., won't fully fill out the U.S. Census form next year, even though that violates federal law, according to the census bureau.
    In a television interview broadcast today, she repeated the assertion she first made last week that she will provide the Census Bureau with only the number of people in her household.
    The other detailed questions, she said, amount to an invasion of her family's privacy.
    "I'm saying, for myself and my family, our comfort level is we will comply with the Constitution Article I Section II," Bachmann told a Fox News interviewer. "We will give the number of people in our home, and that's where we're going to draw the line."

    Nothing to do with the census of 2010 specifically. She's claiming all censuses are illegal. If she's worried about government surveillance, why didn't she speak out against Bush's Patriot Act. That was a true violation of our constitutional rights.

    Well, lets see, the Constitution provides for "The Senators and Represenatatives shall receive a Compensationf ro their Services to be ascertained by Law,... Article I Section 6

    Rep Bachman, the Constituiton says we must give you a salary, but thats all. Are you going to draw the line and refuse to accept retirement pay, medical plan, free travel, ect, ect...

    Are you claiming that if you had refused to fill out a census form in the 2000 census for instance it would have any different results?

    I think he is right, she seems to be talking about the process itself and not this one census. The problem with only putting the number in the households, how do we know how many times a person is being counted or even if they are including their fish and other pets?

    With ACORN doing the counting it is obvious where the fraud will be and who it will help.

    Why do they need to know what time I leave for work, or how many cars I have ?

    Just as I thought, the lefties that berated the Patriot Act are silent on this intrusion.

    The census would be constitutional if it only asked how many people were in a household. All the other questions make it un-constitutional.

    That's the interview that made me research this.

    Anything to add on the subject would be welcome, as she really isn't the point. The point is the constitutionality of the census, which you can look at via the link I provided.

    The census is used for a number of legitimate purposes, not the least of which is establishing congressional representation. I don't know how intrusive the questions are in the past, but I do think that unless we have a better solution it is necessary. The questions should be the minimum to get the job done.

    I know that doesn't address the constitutionality issue, but I have yet to dig into that, other than knowing that the Constitution does require an "enumeration" shall be made every ten years. Seems to me that would settle the matter.

    "Since a capitation means a tax of the same amount for every person, this provision makes doubly sure that all federal taxes must be at the same uniform rate for everybody. This limitation that direct taxes be levied by the Federal Government must be in proportion to a census and apportioned among the States in accordance with numbers, is the only provision in the Constitution that is stated twice.

'No capitation, or other direct tax shall be laid, unless in proportion to the Census of Enumeration hereinbefore directed to be taken.' And in those two sentences our forefathers bound fast the hands of Congress and secured the liberty and freedom of the American people. How? By making it utterly impossible to levy an income tax.


    "An income tax is certainly a direct tax, probably the most direct tax of all since it cannot be shifted but must be paid by the person receiving the income. By specifying that direct taxes must be levied in accordance with the number of people, not upon what they produced, as in the days of ancient Egypt, an income tax was simply out of the question. It cannot be levied upon a man but must be levied upon what he receives.

    "Our forefathers designed and incorporated in the Constitution a new system of government. It was built upon a revolutionary idea; the conviction that the government belonged to the people and existed only by their consent. Its genius lay in the careful system of checks and balances among the three departments, the Legislative, the Executive, and the Judicial. And it went further and maintained a balance between the powers of the individual States and the Federal Government. In addition it carefully reserved to the States and to the people all rights and powers not specifically delegated, or prohibited to the Federal Government and further stated that because certain rights were enumerated in the Constitution it did not mean that others not mentioned were still not the property of the people.
