Mortgage Issues

    Having issues with my mortgage company. They say they are doing a "Workout" so that I can get caught up, but continue to put me off, saying to call back again. This has been going on since January, ant they will not accept any payments from me while this process is going on.
    I received a letter from a lawyer saying that this bank, Mellon of New York, works deceptively, saying that they will work with you, then will not and forclose on you anyway.
    I really do not want to lose my house, we have lived here over 20 years. Also, I could not find anywhere else to live at the same low rate that our current house payment is.

    Please pray. If anyone has had experience with this bank, or Bank of America Mortgage, helpful tips are appreciated.

    If you have money to pay towards your mortgage (and you wish to keep your current mortgage), I would absolutely not stop sending in money. If they have not started a foreclosure process, they are in no position to refuse your payments. Send in the payments and since something fishy is going on I would add delivery confirmation on the postage.

    Any correspondence you get from them... keep on file and stamp or note the date received.

    If possible, get all refusals to accept payments in writing. If you can only get it by phone... then get several phones connected and witnesses to the conversation and log it with the names of those who witness the call (a conference call... or several phones with persons on each listening). Try to get reputable people who would be willing to testify.... not merely present an 'afadavit' which might be refused by a court. See if there's free counsel in your area....or if someone in your church or denomination knows a suitable attorney with reduced fees to assist you with advice.

    Any payments you make or any correspondence you send... also send by certified receipt requested and keep copies on file with certification attached.
    Remind them in each of the timing of your initial request and their continued delays. Though it may seem tiresome... keep communication attempts going from your end..... taking care to keep it civil and polite.... and no threats. If you have a B plan... that's between you and your counsel, if you have one... but it is none of their concern. By all means... stay on top of it.... and keep records.....

    Log all phone calls (date, time, number dialed, extentions, department transfers, questions you asked.. name of persons giving response and what they said, title and position or authority if you can find out).... if possible.... record so that you can make exact notes of what was said... but be careful about keeping recordings unless you know the laws in your state and whether or not you've complied legally if norification to them is allowed and permits your recording.... only which in that case... keep the recording.

    Everything you do may be supeonaed by them... but it may also help you if can show your own records of good faith attempts to cooperate with them and to get their help. You might also check with your local district state representative to see if your state has a consumer liason or agency which can either advise you... or has regulations which a mortgage or lien holder must also comply with and if there are any obligations which you might've missed as well in doing your own due dilligence in this matter.

    Above all, try to keep your wits about you: Find some practical way to work off the frustration so that it doesn't build and come out in a destructive way. Keep your spiritual priorities straight and remind yourself that everything in this world is material, temporal, or temporary, but your citizenship is eternal and sealed in heaven. Pray for them that God may give you grace and break down the barriers opposing you.

    I will pray for you. Let God guide you and keep you in perfect peace.

    Thanks. i called them again, and they said that my account had been assigned to a particular person for review. I asked if I could speak to that person, and they said no, just that I should call back again at the end of the week.
    This is so frustrating. My whole life is on hold until I can get this reconciled. Well, maybe not my whole life, but it seems like it.

    Windcatcher's advice was spot on. DOCUMENT EVERYTHING and KEEP PAYING. The courts will not side with them. There was JUST a case of a bank doing that in the paper this week. Let me see if I can find it.....

    Shoot - I can't find it right now but it was a bank that was doing similar stuff to you and the judge eliminated all of the fees and found in favor of the family. If I find the article, I'll post it.

    I'll be praying it works out for you!

    Update

    Update on our situation.

    We finally received a modification offer, one that we can live with, although not the best. But I'm in a position of beggars can't be choosers right now. And after they added $7,000 of misc expenses. Sounds like a scam to me. [$2600 lawyers, $300+ inspection fee, etc. I don't know of any inspection, unless someone drove by and took a $300 picture. ]

    Still will be paid off in 8 years, like the original.

    We should know in about a week if everything worked out alright.

    Called them yesterday, and they said everything seems to be in order, and to start making regular payments again on July 1 as stated in the modification agreement.
