    He's stretching.

While I agree our laws ought to reign supreme, especially above international law, not so much above state laws, it isnt' treason for a court to consider what other countries have to say, until the legislature and the president get together and pass a law telling them not too.

This is a gray area in our Constitution. One that our Founding Fathers probably never thought needed to be set in stone. Since its a gray area treason can't be proved unless it is first proven that by considering/passing said law provides aid and/or comfort to the "enemy".

And when it comes to that, how much foreign aid/military supplies and the like did I just see a report on that was being sent to the Taliban in Afganistan. Should we prosecute the Pentagon?

    >Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort.

Anyone else notice the interesting pronoun?

Lousy wording to our ears, but the old writers were not that far removed from jolly old England and it's butchered treatment of that we jocularly call English. (tongue partially in cheek)

Intentional. It was still the several united STATES. Not the United States that we now have.

And it was changed in Lincoln's revolution and it has been down hill ever since!
