Will Obama Use Executive Power for Gay Marriage?

    I firmly believe that our communit organizing president will usitlize his Executive Powers to issue an Executive Order allowing gays to marry.

    Today, at his inauguration, we saw a subtle hint of his intent to do something for gays, and since they want the right to marry; and he's supported that right; I believe he will circumvent state power and authority and issue an executive order allowing for some kind of federally approved marriage certificate for gays to marry and for that marriage to be recognized federally speaking. And if states want to receive money for programs that rely on federal funds, the states will have to accept the marriages.

    Why not, he ignores the law of the land in DOMA, so it would be nothing to continue that policy. That is why many are calling him a dictator or king. I know this enflames many on the left but it is what it is.

    No, Obama will not issue an executive order to establish gay marriage. That would be blatantly unconstitutional. I find the question to be preposterous on its face.

    Executive orders are powers given to the President to delegate authority within the Executive branch of the government. Since marriage is regulated within each of the 50 states and since marriage does not fall under the purview of the Executive branch the question is preposterous.

    What other questions may we expect? Will the President issue an executive order setting the legal hunting age at 30 years of age? Will the President issue an executive order setting the sales tax rate of all states to 14%?

    This idea that the president is going to use an executive order to override state laws on marriage is yet another of those totally unfounded prophecies that we hear about him.

    I wish there was a book on all the failed anti-Obama prophecies.

    Will he? I don't know, but it fits his profile.

    Is it in the wind? He specifically mentioned the gay agenda in his inauguration address and passed on others things one would have thought were more important. So, maybe.

    I won't predict it, but I wouldn't put much past him. He's already used EOs to make laws he couldn't get through congress. Why not this one , as well?

    You may see why I am thinking that he's planted the seeds of hope in the gay community. By the way, this young poet was the first openly gay person to have a part in the Inauguration.

    I hope C4K [and the others] is right....but I think he's going to make try a "Quarterback sneak" right up the middle of the line and into the end zone!" If not that, he has the option of an "End run" or a "Hail Mary!" :wavey:

    I wish the shrill right wingers would drop the prophecies and get back to quasi-factual issues like "Obama doesn't wear a flag pin on his label anymore" or "Obama had the U.S. flag on his plane repainted, AND IT'S 10% SMALLER!" or "Obama puts his feet up on the desk in the Oval Office", "Obama moved statue of Churchill to White House basement", "Obama's reading a book by a known Leftist" <gasp!>.

    The man has a law degree, was president of the Harvard Law Review, and taught constitutional law. He's definitely NOT going to attempt to issue an Executive Order that would blatantly contradict the 10th amendment. Sheesh.

    I said "not sure" for a couple of reasons, the primary is that while I don't think he'll attempt to legalize same-s3x marriage, he might try another avenue to find a mediating position.

    Specifically, one of the first steps (outside the legislative avenues he'll doubtlessly try) is an executive order (or two) where he extends federal employee spousal benefits to same-s3x couples. Then, or in place of this, is the extension of the joint filing status for same-s3x couples by the IRS.

    After hearing his remarks, seeing how he's lining out leveraging his second term agenda through the use of significant holidays for major events (inauguration on MLK, State of the Union on Lincoln's Birthday, etc) I think President Obama is going to adopt the mantle of the Great Emancipator to recognize same-s3x marriage, the next great "emancipation."

    Though Congress will balk on this, the Supreme Court is going to have to hear a case or two. And here's the thing folks: the same-s3x recognition movement is a social juggernaut. It is going to happen, in some form or fashion, by the end of his administration. That is just part of the reality we must exist in. I don't think it will destroy our nation (any more than our leaders have been attempting to do) but it is the next step.

    Just my few, meager, opinions. :)

    I can see why you might say "not sure" given that RighteousDude has a habit of wording the title of his thread posts differently than the actual wording of the poll, which is different than his comments within his opening post of the thread.

    In his opening post of the thread he stated, "[Will Obama] issue an Executive Order allowing gays to marry?" That's the question I answered and the answer is obviously, NO.

    I see your angle on the issue and agree that he could issue EO's extending spousal benefits to gay partners but that's definitely not legalizing gay marriage.

    ....though I'm a pastor at heart, the social worker skills of skewing the numbers and words in polls still has a habit of coming to the top :laugh: I try to not do this, but it happens.

    BTW - Am I the only poll maker that does this? Or could you be a little picky and judgmental because you do not see eye-to-eye with my beliefs and thoughts? :wavey:

    I've noticed others do it as well. What you call "picky and judgmental" I call a lack of clarity. You are essentially asking three questions which makes it difficult to answer clearly. Has nothing to do with your opinions. Go back and look at some of your other polls. I think you will see one question in the poll title, another variation of the question in the thread title, and yet a slightly different question in the opening post.
