    Since the prosecutor is on record as saying Gray died from an accident in the van, it's going to be really hard to prove any murder charge.

    The involuntary manslaughter charges will stick, and it will open up these six, and possibly the BPD, to civil rights charges.

    That is one reason they give prisoners the 'rough ride' or the 'nickle rice', as they call it in Philadelphia. The police can always say, "We didn't touch him." I think you are right on the manslaughter charge.

    I doubt this will slow down the Baltimore police much. After all they have paid out millions the past few years in other lost cases.

    Our just past governor set the tone through things he did to boaster his political ambitions.

    It reenforces two points I've made several times.

    Police unions are too powerful. I imagine there's pressure on whistleblowers, and the bigger the city the bigger the problem. I'm 100% positive in a big brother city like Baltimore, protocol says secure prisoners during transport. It wouldn't surprise me if its federal law.

    Democrats cannot govern. This was and incredibly stupid comment for a city prosecutor to make and while it may not have totally poisoned the case, these guys will get 5-8 years each. The only hope for real restitution is a federal civil rights case. But the feds are full of democrats, as well, and I go back to my first point. The powerful union, and the inept prosecutor's loose lips, just might be related ?

    I think Gray's civil rights were violated as soon as the truck was put into gear.

    Cops lied he had a switchblade according to the Prosecutor. She stated it was a legal knife.

    Second degree murder isn't bound by her comments. Accidental or not, the case can be made that Freddie Gray died as a result of an act that was intended to cause bodily harm or that was done with indifference to human life.

    Both qualify as second degree murder.
    As it should. This behavior is systemic as it is in so many other police departments. These rough rides have been going on for a while and everybody knows.

    This is a culture as are the unlawful arrests. Blacks and Hispanics across the country have been saying things like this have been taking place for decades but no one would do anything.

    Prosecutors would not prosecute. Hopefully that is changing.

    I find it odd that Fraternal Order of Police wanted the SA to recuse herself and bring in a special prosecutor when it concerns his officers NOW. But doing so just hasn't made sense in the past when officers were killing people.

    Most of the charges will never stick. They will be summarily dismissed against at least 3 of the officers.

    Appeasing the public is all that's happening. Just like Zimmerman.

    Maybe it will stop the rioting. Doubtful, since the rioting has nothing to do with Gray, but maybe.

    Well yes appeasing the public is a good idea when you trump up a charge to arrest somebody, lie about it, and then fail to do the duties you are responsible for resulting in the death of a human being you had no right to detain in the first place.

    There was no trumped up charge. They had probable cause to detain and search. They found a knife they believed to be illegal and arrested him. Nothing "trumped up" about it.

    If the knife was found to be legal, he would have been released. But he apparently killed himself first. That is not a determination for an officer in the field to make. It was close and he was legally arrested.

    Most, if not all, of the charges will be dismissed.

    Uhhh, she's the prosecutor, so I kind of figured out that she thought the arrest was illegal the minute she wrote "false imprisonment" on her (rushed) statement today. Was Freddy read his rights? Formally arrested? I don't trust anything this city attorney says, she's a noob that maybe compromised:

    Determining the difference between a switchblade and a pocket knife is a decision that can't be made in the field? What? :eek:

    Can you say for sure that the blade wasn't open , which violates the law in Maryland or the knife hadn't been modified to open one handed with a flick of the wrist, also illegal.

    The knife was described as being legal. That's why the officers are being charged with false arrest.

    "The officers who arrested him “failed to establish probable cause for Mr. Gray’s arrest, as no crime had been committed,” she said, describing the arrest as illegal. Officers charged him with possession of a switchblade, but Ms. Mosby said, “The knife was not a switchblade and is lawful under Maryland law.”

    Furthermore, I don't have to prove that he didn't have an illegal knife. The police have to prove that he had one. Good luck with that.

    This is just beyond stupid. If we can't say it, the cops can't either. They didn't even know he had the knife until AFTER they stopped him.

    Who cares that he had a knife on him?

    He was alive and walking and running before the police chased him. And then suddenly 80% of his spine is severed and his larynx is crushed after being in their vehicle.

    No justification at all.

    Lock em up and lose the keys.

    That's the one thing you have said that is correct..

    But then, it doesn't have to be proved anymore, and never will. Most of the charges will be dismissed.

    Didn't have to. They had probable cause to detain him and search him due to him stupidly running from them.

    Huh? It does have to be proved. It's the reason they arrested him. If they are wrong and it's already out there that the knife was legal then it was a wrongful arrest. That isn't exactly a good thing for their defense now is it.
