An FBI "A-team" is leading the "extremely serious" investigation into Hillary Clinton's server and the focus includes a provision of the law pertaining to "gathering, transmitting or losing defense information," an intelligence source told Fox News.

The section of the Espionage Act is known as 18 US Code 793.

A separate source, who also was not authorized to speak on the record, said the FBI will further determine whether Clinton should have known, based on the quality and detail of the material, that emails passing through her server contained classified information regardless of the markings. The campaign's standard defense and that of Clinton is that she "never sent nor received any email that was marked classified" at the time.

It is not clear how the FBI team's findings will impact the probe itself. But the details offer a window into what investigators are looking for -- as the Clinton campaign itself downplays the controversy.

The FBI offered no comment, citing the ongoing investigation.

A leading national security attorney, who recently defended former CIA officer Jeffrey Sterling in a leak investigation, told Fox News that violating the Espionage Act provision in question is a felony and pointed to a particular sub-section.

"Under [sub-section] F, the documents relate to the national defense, meaning very closely held information," attorney Edward MacMahon Jr. explained. "Somebody in the government, with a clearance and need to know, then delivered the information to someone not entitled to receive it, or otherwise moved it from where it was supposed to be lawfully held."

The Democrats are telling us clearly that they are going to nominate Hillary. Therefore, that means that she will not be charged with anything by the Obama Department of Justice.

Probably she belongs in prison but as the wife of a former president, she is immune from prosecution.

She is not very intelligent--have you ever listened to one of her speeches? She is little more than a placeholder for a third term of Bill, who legally cannot run again but who still lusts for power, er, women.

Obama can hardly afford to bring charges against Hillary. He himself knew all along what she was doing and he himself is guilty of many charges of violating American law. Hillary could put Obama in prison if she were elected after having charges levelled at her by Obama. The Democrats are the team that can't shoot straight. Their god is big government and their cry to Evangelicals and Fundamentalists is that we are violating Scripture by not spending more money on Democrats.

Outside of the Democrat Party members, the Democrats do not care about anyone. The do not pay any attention to Human Rights and human suffering and misery are not even on their radar. They love power and money. I doubt seriously if a plurality even of Democrats believe that man is made in the image of God.

Again, more theater. Did we expect them to say we got our D Team looking into this waste of time and taxpayer money witch-hunt for nothing?

Another reason why this is going nowhere and Hillary will be President.

It is just for show but Hillary did do something very stupid and very illegal but it is just for show because she is Bill's wife. She is our Eva Peron whose old man wanted her made a Catholic saint and probably Hillary will be suggested to the Vatican for a Catholic saint.

If this is a witch hunt, then we have found the witch--Hillary! :wavey:

Oh, no, don't start that line of reasoning--Evangelicals and Fundamentalists are well-educated. We know perfectly well that people have been prosecuted for e-mails. Hillary did something stupid, maybe because she was so egotistical that she wanted all of her documents for her presidential library. There is nothing Christian about the Clintons. Bill plead guilty to charges of perjury in his attempt to cover up his adultery. Hillary has been caught in many lies, dating back to her smear of Edward Brooke. She is the daughter of wealthy white parents and she thinks that she is something other than a poor little rich girl. Have you ever listened to one of her boring speeches?

It's hard to be President when she quits the race before the Democratic Primary.

Mind if I quote you when she pulls out of the race? That should be a little more than a week from now in my opinion.

She'll be signing a deposition --a sworn testimony before long.

She's done that before. It won't amount to anything. GOP'ers are grasping for straws just like they did with Obama and Jeremiah Wright and Salinsky and the birth certificate and every other scandal they tried to make stick.

    It's a rather sad display.

What is sad is the level of depravity in our government such as Obama, Pelosi, Reid, and Clinton have displayed for all the world to see.
