Clicking on this link in the article takes you to the website for the Office of Information and Regulatory Affairs within the Office of Management and Budget, where the proposal is displayed. There are two links within the proposal, purporting to show authorization for such action.

The links both go to the exact same document they are located in. Hm ...

    Huh…..

My question is, does the zero want separate water fountains, and special seating in diners, as well. Maybe separate movie houses, and schools, too.

Indian tribes in the US have the authority to levy tax of their own at business they own. (and to exempt Indians from that tax)

Yup. I gladly pay my Reservation Fees, so I can fish in their lakes.

But if they commit a crime, they are charged and tried by the state.

In New Mexico when Indians commit a crime on the res there is nothing much state law enforcement can do about it.

As U.S. citizens, Indians are generally subject to federal, state, and local laws. On Indian reservations, however, only federal and tribal laws apply to members of the tribe unless the Congress provides otherwise. In federal law, the Assimilative Crimes Act makes any violation of state criminal law a federal offense on reservations. Most tribes now maintain tribal court systems and facilities to detain tribal members convicted of certain offenses within the boundaries of the reservation.

It appears they function more like county police, and that is not what this article is talking about.

I can tell you that in NM law enforcement does not go on the res unless it involves a fed crime like murder.

Murder is a state charge, not a federal one.

The problem with this is that native Hawaiians are distributed throughout the islands. You can't take the 7,300 acre tract of land in the original agreement and suddenly tell native H's "you have to live here to enjoy reservation-type status."

If implemented as the state of Hawaii currently exists, it will create a special, privileged class of citizen in that state - something that Congress and the Supreme Court have both avoided, and for good reason.

You are right what I should have said was more serious charges. I watched law enforcement take weeks to bring a man off the res after killing someone on the res with a bat. It becomes a complicated issue. It may be that with lesser charges they just do not pursue it because of that.

I know our res doesn't have money to prosecute crimes. My buddy got a ticket for poaching fish in one of their lakes, and six months later got a letter begging him for the money, as they just couldn't afford to chase him for it, and it would be a bummer if this kept him from getting his state license renewed.

Obama Desires Two-race Law in Hawaii...

You can read for yourself what Obama is quietly thinking of initiating in Hawaii, and I ask this, would this not be "Divisive," Racially Segregating and possibly even opening the door to the introduction of Sharia's law, which Muslim-Americans are wanting? Mr. Obama calls this a diversity proposal, to level the playing field between native Hawaiians who dislike whites.

In my mind, I see it as what Native Americans have set up on reservations, when they police themselves under tribal laws, BUT I have to wonder if there is more to his proposal that meets the eye?

So, what are your thoughts on this, and do you even see it as being remotely possible? :type:

Capital crime on a reservation is a federal crime, investigated by the FBI.

    Thanks ..... BUT-

I was basically asking if this were to go into effect if that would pave the way for Sharia law activists to have a claim for their laws to be imposed on Muslims in America?

Thanks for getting the thread back on topic

Frankly, I'm amazed this hasn't become a major issue in the conservative media. This would set a precedent for minority groups having a majority say in how this country is run and in what direction its leadership takes it.

You ask good questions. I think my point about the water fountains is a good one, as well. Maybe I'll report this and we can merge ?

This isn't about Jim Crow style segregation. Nor is it about being "race" based (contrary to the article's vocabulary). The Kingdom of Hawaii and after the monarchy's overthrow the Republic of Hawaii were internationally recognized sovereignties. Before annexation, there were properly established diplomatic (British, French, Dutch, et al.) embassies in Honolulu. Further, Hawaii had fully functioning "European" style legislative and judicial systems.

The legality of Hawaii's annexation is a matter of debate. Though, such debate in reality lies in the philosophical sphere. As, it would be a matter of un-ringing a bell.

So, what is being proposed is something closer to the system in Quebec. There are recognized presumptive heirs to the throne.

The problem lies in the mentality of the sovereignty proponents. Are they willing to abide by the wishes of their monarch or do they want to return to the pre-Kamamah days before the unification of the kingdom.
