I brought this up in another thread, and it is a Constitutional or technical question. If it was proven beyond any doubt that Obama was born outside the United States, with six months left to serve, what would happen?

    1. Would it require impeachment by Congress to remove him?

    2. Would it just be an administrative action of removal?

    3. Would the country say it is just best to serve out six months, but not be allowed to run again, then prosecute for election fraud after leaving office?

    4. Some other method

My only comment is, would you really want Biden to be President even for a day?

I would appreciate any responses from anyone who knows the procedure in a circumstance like this.

If he did not resign the procedure could happen very quickly. If the fraud were clear it would be very cut and dry.

The House would have to draw up articles of impeachment for fraud in presenting a forged birth certificate. When that was done they would have to vote to impeach him. If they did he would be tried by the Senate. If convicted he would be removed from office. Theoretically if the document were clearly a fraud this could happen within days.

Chances are that if he did knowingly commit fraud he would just resign cutting a deal with Biden that he would be pardoned from further prosecution.

Of course the Democrats would be wide open for their convention to choose another candidate.

Since the Republicans control the House they might muster the votes to get an impeachment hearing to the floor. They would be reluctant unless the evidence were very, very strong. If they don't really have the goods they would be foolish to try it.

I, for one, fully believe that the president was born in Honolulu. No one would be stupid enough to attempt fraud at this level.

As long as the Democrats control the Senate and Harry Reid is in charge, I doubt he would be tried, let alone removed from office, even though that is what the US Constitution requires.

I do believe there are some in Congress that believe obama has a fraudulent BC, there are definitely some that know he "won" the election by voter fraud. John McCain refused to challenge it according to Wikileaks:

    http://wikileaks.org/gifiles/docs/3...s-and-dirty-tricks-internal-use-only-pls.html

Technically, and I believe Constitutionally, every law obama signed and every executive order should be thrown out as invalid.

I do believe federal judges have been bought off over this and/or threatened because there have been multiple court challenges regarding the BC and obama's proported Connecticut Social Security number that belongs to a dead man, but every challenge has been thrown out for various reasons.

    Also, there is this:

In a previous thread, I have already mentioned the meeting with the SCOTUS a week before the swearing in.

I find it ironic that the people who screamed the loudest about chads in Florida ended up pulling the biggest hoax and fraud and voter/electorate fraud on the American people in the history of our nation.

I do think that with the obama machine revving up the divisive card, rich vs poor, men vs women, Reps vs women, religion vs the state, fossil fuels vs green, black vs white, calling certain tax payers terrorists and enemies and telling Hispanics to "bring a gun to the fight"
and even interjecting the Office of the Presidency of ALL Americans into the Trayvon Martin case in Florida over an alleged murder in order to ramp up the race card, he is setting the stage for riots in the streets in which he will assume total control of us in a police state. Why Republicans in Congress can't or won't see what is happening (like with the drones in US skies) is incredible.

Get ready, the obama Chicago machine hasn't even gotten wound up yet.

IMO, I know how it is all supposed to work according to our Constitution. Unfortunately, when we have had even Republicans like (the late?) Congressman Henry Hyde (from Illinois, ironically) who stated that the "Constitution is no longer relevent" years ago, our system of checks and balances has broken down, so in answer to your question, I do not believe he would ever be impeached or removed from Office under any circumstance. I do believe, in practice, we are sliding towards a dictatorship, and most patriotic Americans "feel something just isn't right" down in their red, white, and blue bones, but just don't know to the extent this is going or what to do about it. :tear:

Even if this scenario played out nothing would be cancelled retroactively. The president was certified as elected. He is the president and can legally act as such.

This all makes a fun 'what if,' but it is all meaningless.

Voter fraud is more the norm than the exception. Even though we all know that President Johnson used fraud to garner votes bills he signed were never questioned.

And beside, the president is a natural born citizen.

    Interesting "What if"

If I'm not mistaken - if the House did impeach - the Senate has no choice but to hold a trial.
So lets suppose that did happen. How would the Dem Senators vote - especially the ones that would be up for re-election this year?

Now if Reid could hold off the trial until Nov 5th.....

It does not matter a whole bunch. He'd be pardoned by whoever took over.

The real question is why did God put Obama in power and what must we do to get back into His good graces?

    http://en.wikipedia.org/wiki/Lists_of_Presidents_of_the_United_States_by_place_of_birth

The following Presidents were born British subjects, as well as American citizens, after the establishment of the United States:
    Chester A. Arthur[9]
    Barack Obama[10]

^ The Official Library of Congress Naturalization Record for William Arthur (father of Chester Arthur) states that William Arthur (who was born in Ireland and later emigrated to Canada) was not naturalized until 14 years after the birth of Chester Arthur. His father's British subjecthood, governed by English common law, was conferred via jus sanguinis; cf. William Blackstone, Commentaries on the Laws of England I.10 ("Of People, Whether Aliens, Denizens or Natives"), Oxford 1765-1769: […] all children, born out of the king’s ligeance, whose fathers were natural-born subjects, are now natural-born subjects themselves, to all intents and purposes, without any exception; […].

^ According to the British Nationality Act 1948, Obama was from birth a Citizen of the United Kingdom and Colonies by descent (jus sanguinis) through his father, a native of Kenya, which was then a British colony. This status reverted to Kenyan citizenship upon Kenya's independence in 1963, and Obama lost his Kenyan citizenship upon turning 23 in 1984 because the Kenyan Constitution prohibits dual citizenship for adults. Golly, Roger--------------you take all the FUN out of the What if's!!!!!

    :type::laugh::laugh:

I believe that if the Republicans did decide to smear "O"'s face in the mud and IF they did prove the Birth Certificate thingy was all a hoax----and O is as guilty as charged-------------you would see the biggest racial riots break out than you have ever seen before

I disagree - 'if' this supposed fraud were proven everyone would be ready to see him go. Black Americans don't like being defrauded any more than White Americans. But it is too big of an 'if'. There is no fraud. There was stupidity on his part for accepting how 'cool' it was to have the Kenya birth said about him and no refudiating (love that word even if I am not fan of the one who coined it :)) it then.

This thread is about how a President would be removed from office in this particular circumstance. It is a technical/Constitutional question. I fail to understand why this has become a debate on the merits of Obama's birth certificate.

*sigh* When you are presented with a bio to proof for accuracy and it said you were born in Timbuktu...do you just leave it at that, or do you actually correct something that the public will see?
