"WE" weren't keeping him. He was not in jail. He was not being held captive or being detained by the US government.

He was living with his family here in the US -- the same family his mom tried to join here before she died. He lived in a neighborhood, went to school, etc.In fact, he did not even live with his father in Cuba before his mom tried to escape to the US.
