Urgent Prayer request....please don't move

    We got a letter in the mail today that our house, that we are currently trying to sell, is going to forclose, TOMORROW.
    I must call the bank tomorrow, and try to talk them into working with us.

    My husband was layed off, and he is now back to work, but we got behind.

    I sent them a payment today, and while at the post office, sending it, we got the certified letter.

    It was dated Feb 14. We just got it today.

    NO notice.

    PLEASE pray that this man that I speak to, will have a spirit of mercy, and will give us an extension so that we can get caught up.

    His name is Andrew.

    We are the Kirby's.

    Thank you in advance.

    God's Will be done on earth as it is in Heaven.

    I have already said a prayer for your family.

    Typically the forclosure process takes a while in most states. I assume that you are entering that process and not that your home will be sold on the county courthouse steps tommorow. If that is the case most reputable lenders would rather work it out with you than to force forclosure.

    If that is not the case and your house is scheduled to be sold tommorow consider calling the bank as well as a bankruptcy attorney immediately, especially if you have significant amount of equity in your home. A bankruptcy judge may be willing to grant an immediate stay and that may give you time to sell your house and with that time you may not have to actually go through with a bankruptcy and the bank would still get all its money including penalties and interest.(It is always best to pay all your debts) The filing of a bankruptcy petition would stay on your credit for a while but not as long as an actual bankruptcy, but double check all of this it has been a while since I dealt with real estate transactions and as I am not an attorney.

    I am in Cali, so you probably are right.

    Here is WHERE we are.

    I made our last on time payment in November.

    The one missed (and the ones after it) were December 1 and January 1 and February 1.

    That is 3 payments.

    I am not 90 days past due though (which seems strange to me that they are threatening)

    We got a letter that if we didn't pay the FULL amount still due that we would be faced with forclosure proceedings.

    So they haven't started yet, and we won't be on the curb!

    But the house is on the market right now and should sell.

    If we lose it, it will thwart all our plans of moving to a new house (this one is old and small) with more room, and with the equity pay off my car.

    So we know it is the devil attacking us, seeing as how we have been praying for so long for this house to sell, and for us to have a way to pay off my car!

    This is a real blow to my husband. He works so hard.

    He got layed off, for almost 2 months. Now he is working TWO jobs. Almost 16 hours a day.

    Pray for HIM too.

    Pray for me especially that I don't lose it while on the phone with this guy.

    I cry easily.

    I cried at the post office today.

    She handed me the certified letter, and I opened it and stood there like a deer in headlights.

    Luckily she had walked off and didn't see me.

    I am a mess.

    If I was especially mean to anyone today, please forgive me.

    I have had a lot on my mind lately.

    I work for a mortgage company and I am a back end collector so I do know what mortgage laws state.

    The letter is a demand letter which by law gives you 30 days from the time it was mailed to make arrangements. Most mortgage companies will defer the payments if there has not been a deferment done recently. I would speak to a supervisor and see if your mortgage company offers this kind of assistance. If this fails then there are other steps.

    Contact your local Hud office and they can send you to organizations that will help you make your payments. The salvation army helps. There are housing authorities that also may be able to help. Get out your yellow pages or white pages and look up the number to the Housing and Urban Development office near you or your city or county or maybe state housing authorities.
    If all fails you may choose to file Chapter 13 bankruptcy. This will stop all foreclosure proceedings and it will enable you to restructure finances and the court will assign payment plans with your creditors to be able to pay your debt back over a time frame. This is not something shameful. Sometimes even Christians have devastating things happen to them and they have to make these choices. This to me is a responsible choice. You would not be running from your debts but would be trying to face them.

    As the economy worsens and with all the layoffs and crooked companies out there filing bankruptcy and shutting down more and more Christians may find themselves having to do these things.

    I will pray for you. WE may differ in our beliefs but Charity begins with believers.

    Update!

    I called the Sr Vice President of the bank and talked with him JUST NOW.

    He said that they will NOT forclose if we get caught up!

    NOW. That means my parents are going to have to get involved, but never the less, the call went well, the man was REALLY nice and understanding, and I only had to ask him ONCE if he could stop the proceedings if we got caught up!

    Keep us on your prayer lists!

    We need all the prayer we can get.

    I wanted to clarify for anyone who might be confused.

    We live in an apartment in California right now. The rent is over a thousand a month. 1200 to be exact.

    We still own our house in Arkansas. THAT is the house they were trying to forclose. NOT HERE. We are wanting to buy a house when our lease is up, so we don't throw any more money down the drain.

    So this house needs to sell. It is a burden to us now that we are renting.

    We are paying a house note and RENT at the same time. Plus 2 car payments.

    Insurance...... you get the idea. [​IMG]

    Pray for my husband to have strength. He is working alot. With 3 growing boys, it is a never ending cycle of pb&j and spagetti. (two cheap food sources) That and the old faithful, beans and rice!

    We don't complain though. It is definatly better than starving!

    Thanks again for all your prayers and concerns.

    I am glad to know that even though just about ALL of the members of this board disagree with me theologically you can see past that to the family of God.
