    A most interesting excerpt from the referenced source:

    While this federalism-inspired revolt has coalesced around gun rights, the broader goal is to dust off a section of the Bill of Rights that most Americans probably have paid scant attention to: the Tenth Amendment. It says that "powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."

    Read literally, the Tenth Amendment seems to suggest that the federal government's powers are limited only to what it has been "delegated," and the U.S. Supreme Court in 1918 confirmed that the amendment "carefully reserved" some authority "to the states." That view is echoed by statements made at the time the Constitution was adopted; New Hampshire explicitly said that states kept "all powers not expressly and particularly delegated" to the federal government.

    More recently, federal courts have interpreted the Tenth Amendment narrowly, in a way that justifies almost any law on grounds that it intends to regulate interstate commerce. In the 2005 case of Gonzales v. Raich, for instance, the Supreme Court ruled that a person growing marijuana for her own medicinal use could have a "substantial effect on interstate commerce."

    (In an impassioned dissent at the time, Justice Clarence Thomas wrote: "If Congress can regulate this under the Commerce Clause, then it can regulate virtually anything -- and the federal government is no longer one of limited and enumerated powers.")


    As usual Justice Thomas is brilliantly correct. Of course the racist liberals on the Forum will likely say he should be "pikin" cotton. As I recall that was essentially the spoken position of one of their great leaders Senator Reid, the democrat Majority Leader.

    Frankly I hope the states wake up before it is too late, call a Constitutional Convention, repeal the 16th and 17th amendments and retake the Constitutional Republic.

    It is the intent of the democrat/Marxists to convert this Country into the United Socialist States of America. I pray that God will defeat their wicked intent and spare this country in spite of our grievous sin of slaughtering 50 million unborn children and their current intent to euthanize the elderly and infirm through the so-called health care bill.

    This bill is better called the death assurance bill, the DAB, since it calls for taxpayer funded abortions and rationed health care.

    Which army/navy base does anyone think a state national guard will fire upon or vice versa?

    Will some national guard drop troops into DC?

    How does anyone propose that this war will start?

    Or say that New Hampshire (free state project <G>) secedes and Washington ignores their communication. What happens next? The retired people in NH stop cashing their SS checks? Fat chance of that!

    Not only have the courts ruled that federal law supercedes state law, but even if it didn't, there is a concern for the feds. For example, Do guns manufactured and purchased in Texas that end up in Ohio being used in a crime make it the concern of Ohio and the feds? Indeed!

    Could Montana outlaw women suffrage in state and local elections? I don't think so. State's rights are not absolute.

    Of course Montana can not outlaw women suffrage as that is part of the US Constitution.

    Your first point about what the courts rule: a decision can always be reversed by the high court .
    Concerning that federal law superseding state law, I agree if the Constitution gives the Feds that right - otherwise, I adhere to the 10th amendment

    Like I guess Neocons hate the Supremacy Clause in Article VI and the 14th Amendment. :rolleyes:

    From Article VI: This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.

    I have wondered about that. Is it possible that a Neocon is a leftist who has undergone regeneration and passed from darkness into light? All I know for sure is that the leftists use the word as a epithet.

    A Neocon is most of the libbies on this board. They try to mix socialism with capitalism and think it will work. Bush was a true Neocon as well.
