French tv report avout NSM

    Hi,

    Yesterday i watched a report about NSM & KKK in USA.

    The most stunning moment was when a policeman comes, and talks with them. A guy stops on the side of the road and says " I like the fact you're cleaning the side of the road, but not your ideas ! ".

    The nazi tells the policeman, the policeman asks the man to leave his car and gives him a fine :confused:

    Does the " 1st amendment " they call upon have strictly no limit ? All the guys raising their hands on the side of the road like under Hitler.

    The part about the KKK was weird, but that about the NSM was ... disgusting.

    Brothers and sisters ! Such things in public places should be forbidden !

    That's my opinion, what's yours ?

    A peaceful assembly is not illegal here, Spear. If a group of Nazi folks want to sit around and talk in a group, that's fine whether we agree with their ideas or not. Now, if they start beating up people or damaging public or private property, the law can and will do something about it.

    Over here, everyone has constitutional freedoms, not just Christians.

    In the corner, you can view the report online, it's in french about voices, but i guess the visual might be interesting.

    In fact, what annoys me, is that considering all the evil in the nazi ideas, where it led in terms of chaos, hate, evil, this should not be allowed, but i understand the amendment protects that fact.

    There's an old adage by Justice Oliver Wendell Holmes, who says says free speech does not give a person the right to yell "fire" in a crowded theater. The US Supreme Court has heard numerous cases regarding what constitutes Amendment I free speech. SCOTUS has, over time, rules that there are limitations to Amendment I protection of free speech. Obscenity, child pornography, threats upon one's life or person, or the use of untruths to harm others (slander), are examples of the guarantee of free speech not applying.

    Freedom of speech also extends to certain expression by non-speech, when the intent of those actions is to express a message in a manner similar to vocal speech. But actions considered freedome of expression come under strict judicial scrutiny.

    Amendment I als guarantees a "right of the people peaceably to assemble". So, as said before, any group, from idiots or nobles, can assemble in public without fear. The definition of "peaceably" can vary, however, depending on situation and scope.

    That's not case that SCOTUS has heard, but there have been lower court cases of people being convicted for possessing hand drawn images that explicitly depict children in lewd situations. From what I've read, that sort of depiction needs to be very obvious, and not an implication, but I'm no jurist.

    Naa... you can't arrest them they just slip right between the bars of the jail.
