*Obama & Holder Ponder Moving Hasan Trial to Criminal Court? (see disclaimer)

    *The TITLE of this POST is nothing more than a hypothetical question...IT IS NOT FACTUAL IN ANY WAY! It was written in such a way to attract attention; solicit discussion; and secure some solid feedback as to whether this scenario could ever happen with the jurisdiction and the eventual adjudication of this terrorist act of mass murder..

    I was simply WOL [wondering-out-loud], and had to ask the following: Is it possible for Attorney General Holder and POTUS Obama to move the trial of Major Hasan to a Texas Criminal Court???

    What made me think this came down to two things:

    1) They have moved the trials of the five 9/11 conspirators to a Criminal court setting, so, what would stop them from repeating this action here, especially if:

    2) Obama and Holder felt that Hasan could not get a fair trial from a Military Tribunal???

    I shudder to think that this could happen, but, I did not think they'd move the conspirators trials from Military Tribunal to Criminal Courts, either!

    I think that the ones going to the cirminal court should be moved back to a military tribunal. So, no, I don't think that Mr. Hasan's trial should be moved to a criminal court. Do it think that the attorney general will move his trial to criminal court after all of the uproar over the other five being moved there? No.

    By the way, I wonder if the possibility of moving the trial of the five could have been avoided if the Bush administration had declared them to be prisoners of war instead of enemy combatants.

    You Hit the political "Nail" on the Head!

    Great question, and very good point!!! I've felt all along that Bush should not have designated them enemy combatants, and in truth, had he simply tried them before he left office, we'd probably not be in this political quagmire.

    It is clearly in military jurisdiction. A military officer against other military officers on a military base. I don't see why Obama or Holder would see a military tribunal as inappropriate.

    I suspect that if Hasan were tried in a Texas court he would get swifter justice and put to death quicker than in a Military Court. Under Texas law he would be guilty of 14 murders since one of the women was pregnant.

    I suspect Texas executes more murderers than the rest of the states combined. Therefore, Obama will not allow him to be tried in a Texas court, sadly.

    I agree with you...but the rule of law is the rule of law. Try this animal in a military court.

    Then let's get him executed, ASAP.

    A military officer commits a crime on a military base while serving actively in the military. How could this man not be tried in a military court. That is unless the goal is to see this individual not put to death.

    I believe this vermin should be tried and executed.

    Let me add, what do we expect when we give our sworn enemies weapons and enlist them in our armed services? You might as well unmuzzle a rapid dog in public and complain that someone gets bitten!

    My guess is he will be tried in a courts-martial, not a tribunal. The C.O. of the base will act as judge, and Hasan will be allowed representation.

    The Military has not tried a death penalty case since the early 1960's. He is much more likely to get the death penalty in a Texas Court.

    Perhaps there is some poetic justice in that he was shot and paralyzed by a woman [at least according to reports].

    The state of Texas has no jurisdiction over a military base. No state does.
