Would you support a bill that would ban, nationwide, abortions except in cases of endangerment to the life of the mother? What provision of the Constitution would you use in support of this? Assume, for the purposes of this hypothetical, that Roe v. Wade is not an issue.

I would support a bill like this because I'm strongly pro-life and I think that elective abortions are immoral and the government should protect unborn life. I believe that such a bill would be constitutionally justified because of the Commerce Clause because abortion has an effect on interstate commerce.

It fails to meet any standard allowing to fall under the commerce clause.

No. I would support a national ban on abortions for all pregnancies where the kid was big enough to live on his own outside the womb even if a c section was required.

Well, God supported abortions until the kid was big enough to raise his own army.

I would support any ban on abortion under any reason just to outlaw it again. But I would like to see the reason be that an unborn baby is a person and protected under our law and constitution with the right to LIFE, liberty, and the pursuit of happiness.

How about just going back to 1972 when it was a crime?

What would be an acceptable penalty for a woman that has an abortion ? The death penalty ?

What about that man that got her pregnant ?

No. I'd punish the doctor who does the abortion.

Exactly. charging the Dr. or whoever is responsible for attempting to or performing the abortion. I do not think anyone is suggesting charging the mother with a crime.

    Why not?

If she were to pay someone to murder her 3 month old child, would she not be charged with murder?

and yes, definitely charge the Dr and any other professional involved with the murder of the soon-to-be-born.

You are right, Salty and I was wrong. The mother should not be exonerated in the commission of a criminal act.

My heart says to not punish the mother, but if a woman knows the penalty, then she should be prepared to pay the price.

Now that know what happened to the the children of Susan Smith, do you think she deserves to have her case retried?

I think that a person who performs an abortion, except to save the life of the mother, should be imprisoned not more than five years, fined not more than $100,000, and placed on probation for not less than one year to not more than five years.

So the slaughter of an unborn child is only worth 5 years.

Why do we make an exception to save the mother's life? Is it ok to kill someone to save somebody else's life?
