    Brett Kavanaugh's accuser wants the FBI to investigate her claims before she testifies to the Senate, and it could delay his Supreme Court confirmation indefinitely

    Attorneys for Christine Blasey Ford, the woman who has accused Judge Brett Kavanaugh of sexually assaulting her when the two were in high school in the 1980s, say she wants "a full investigation by law enforcement officials" before she'll appear in a public hearing, according to a CNN report published Tuesday.

    Ford's attorney's wrote a letter to Sen. Chuck Grassley, the Republican chairman of the Senate Judiciary Committee, saying an FBI investigation would "ensure that the crucial facts and witnesses in this matter are assessed in a non-partisan manner" and would be critical "before conducting any hearing or making any decisions."

    The judge already has had 6 Fbi checks uinto his background, would the Dems ok them to do all of their background checks also now?

    That is the position of the Justice Department as well ...

    "The Justice Department said in a statement on Monday that the sexual-assault allegation "does not involve any potential federal crime" to warrant an FBI investigation, according to the Associated Press. It added that the department's role in conducting background investigations during the nomination process was to determine whether the nominee might be a national security risk."

    It depends on your idea of justice. Some believe each crime needs to be paid for justice to be accomplished. We see this in situations where a man murders someone and then is caught decades later, after he has become a "different person" (this happened several years ago in Tennessee - the crime was committed when the guy was a teenager on drugs, but when he was caught he was a father raising two children and active in the community....some argued he should be released, others that he had to be punished for justice to be served).

    The idea in general comes from our ideas about justice (worldly justice denies simple forgiveness). If he is guilty of attempted rape or sexual assault, even as a teenager, then he is guilty. I suspect the idea insofar as this case goes comes from wanting to delay the appointment in hopes of a shift in power.

    There is no statute of limitations on murder. There is one on rape. It is long, long, long, past. I don't think he assaulted or raped her.
    I have been at plenty of high school and college parties where women "sexually assaulted" me (by today's definition) . I must admit that I loved every minute of it.

    There is not one on rape in MD (but we are talking misdemeanor sexual assault and she would have a year to bring charges)...unless things have changed.

    The issue is his appointment. If he is guilty (regardless of whether not charges can be brought) then he is unrepentant of sexual assault or attempted rape. It speaks to his character.

    Personally I believe the charges may be true but the Democrats are trying to use it for political gain. I believe people do change (I am not the same person I was 25 years ago, much less when I was a teenager).

    Is two drunk teenagers making out "sexual assault"? Everything is ok. Touch this ok. That ok. That Ok. Touch something else, girl says no. He stops. Does not seem like assault to me. Everybody is different. Some girls are wild and rough. One of my friends g.f. used to claw his back up like a cat had jumped on him and leave bruises and various other marks all over him.
    I think you have to look at intent. Did manX intend to assault femaleY, or just try something she did not like and quit when told to do so?

    The only account of an incident is that a drunk teenager sexually assaulted a girl. The man in question says the event didn't happen.

    I don't think intent is the deciding factor, but perhaps it is a factor. We are still responsible for our conduct even when we are not necessarily in control of our conduct. I think this applies not only to sexual assault but to drunk driving as well.

    The accusation can't be used for criminal charges. The question for me is not whether a drunk teenage boy tried to force himself on a classmate. If guilty the question for me is how the man handles his past.

    There can be no criminal charge i.e. attempted rape - if the statute of limitations has run out.

    Exactly. But no one is talking about criminal charges - they are talking about the man's character as it applies to his appointment.

    I just find it odd that some take certain stances about justice, guilt and punishment when it comes to theological ideas but abandon those convictions when it comes to "real life" (or their personal politics).

    I was addressing the "why" question in the OP. Whether or not he can be criminally prosecuted speaks nothing to guilt.

    Except the "man" in this instance was a horny, buzzed, curious 17 year old teenager. Perhaps this incident, if true, brought shame and remorse to him and was instructive to him. There have been no other alleged instances of this sort of thing following him.

    How do you know he was 17? I think he may have been 15 or 16. Accuser can't remember when it was.

    If the accusation is true and he was "staggering drunk" he may not even recall the incident.

    I believe he should be appointed. But at the same time we have people here who hold theological ideas about justice in opposition to their "real world" views (e.g. the relationship of repentance to forgiveness; retributive justice; the ontological nature of sin). That is more my point.

    IOf she will not testify, and since the person she did named as being there as stated he remembers nothing happening, this smells of politics!
