8th Amendment of the Constitution

    The 8th amendment states:

    In your opinion what is "cruel and unusual punishment?

    I presume this was added to prevent some forms of punishment back in the day that was considered cruel--the stockades in the public square, burning of alleged witches, the stretching rack, etc.

    I guess it would also include capital punishment for minors and the mentally ill.

    A lengthy sentence for a relatively light crime.

    Deciding what is cruel and unusual punishment is all someone's opinion, isn't it?

    Really? They deserve each other. Could make for interesting entertainment if a Webcam was installed in their cell. :laugh:

    "Cruel" is causing undue harm. The death penalty is not cruel in and of itself. It becomes cruel when it causes undue physical or mental anguish.



    "Unusual" is a form of punishment that is not usually assigned for that crime. If almost everybody gets 3-5 years for armed robbery, and then someone gets life, that's unusual.

    Cutting off the hands of thieves?

    Public lashing for comments on a blog?

    Public execution for blasphemy, acts of homosexuality, treason, or murder?

    Death by stoning for adultery?

    Cutting off a hand *and* foot for banditry (theft)?

    Death or crucifixion for banditry that involves murder?

    So how do we define "cruel and unusual punishment"?

    SO: How do we define "cruel and unusual punishment"?

    Cruel = you cannot torture a confession out of them for one, Cannot play hothand with them like the Romans did with Christ just to be vindictive.

    Unusual = out of the norm not the same as normal punishment would be for that crime. In other words 30 years for a misdemeanor crime would be unusual.

    Outside of what God instituted would be unusual or cruel. Since God instituted Capital punishment then Capital Punishment would not apply as cruel and unusual.

    Some examples of cruel and unusual from the history of the Democrat Party: Slavery, abortion, the notion that s0d0my is natural, Jim Crow, KKK.

    Having to read through your rants and ridiculous posts. Believe me, killing a killer is not cruel. And why do we worry about their pain. Did they worry about their victims pain and suffering when they murdered them? I think not!
