    Over on the thread about McArthur - and his church (illegally ? having indoor services)

    I had stated: "First amendment - Govt is to stay out of the business of the church - period"

    So should that be an absolute right?

    For example :
    1) Should a church parking lot be required to have handicap spaces?
    2) Should church kitchens be inspects by the county health dept
    3) Should the church building be inspected for potential fire hazards.
    4) Should church owned vehicles be required to pass safety inspections?
    5) Should the govt be allowed to force a church building to close during
    periods of declared emergency - ie the Chinese Virus
    6) Should churches be required to pay taxes.
    7) Other

    No right is absolute. That is the main function of government - arbitrating between rights and the interference with rights. After all, stealing is interfering with the owner’s right to his property. Physical harm interferes with a person’s life. If more than one party claim to own a piece of land, then government arbitrates between them. We are individual persons and we are also a community of people.

    There has been previous debates about churches incorporating. When a church incorporates, it fills out paperwork identifying itself as a “corporation” of the state usually as a tax exempt entity.

    That gives the state the right to govern the entities under its control. Most states have specific language for churches, but the regulations you mentioned concerning building codes would need covered.

    As far as shutting the church down during a crisis, that might be determined by courts and Christians don’t usually fair well in secular courts.

    In NY State - INC means that the church is now a "legal person*) - otherwise the pastor, and/or trustees and/or even members could be legally responsible for any legal action - lawsuits, ect.

    Sales tax exemption is a whole different story - other churches I have been in had sales tax exemption even though we were not INC.



    INC has nothing to do with control churches - at least in NY State.
    NY State laws pertain to both inc and non-inc churches.


    Thus the reason I am thankful for Christian Lawyer organizations.

    Recently, here in NY - New Hope Counseling was informed by NY State - they would have to allow h0mos@xuals and non-married couples to adop.
    New Hope refused. The organization helping New Hope was "Alliance Defending Freedom"





    * Not sure if that "legal person" is the elect or not

    If congress and all its subordinates, can make no law regarding religion, how can they do any of those things listed?
