Paul you are spouting off the same kind of (things) I heard when I was in college from elitist professors. Maybe one day you will work in the real world, grow up, and quit drinking the kool aide produced in ivory towers.

Certain courts disagree with me all the time (see "9th Circuit Court of Appeals" and cross-reference "overturned" and you'll see what I mean)...it doesn't mean they have a clue.

If it's just the same to you, I'd rather not take any European countries as examples for how I want my country to be...not the best of templates there.

But see, there's the problem: The inherent growth of the Socialistic state virtually guarantees an infringement on personal rights and private property. Government simply doesn't "grow smaller" on it's own. Without the watchdog in place, it takes over. And with a "commerce clause" interpreted (wrongly) by our courts to give government carte blanche for its use (abuse) of power...Well, there you go. And a socialistic system means we're already on the way to a regime that opposes freedom.

What you are describing IMHO doesn't exist long-term. You've inadvertently hit upon an inherent weakness. Over the long haul, either freedom or tyranny wins out. This strained hybridization won't work for long. And there are multiple ways it gets resolved: Islamic conquering (sharia law), A revolution back toward individual liberties, or the continued growth and eventual totalitarian nature of the empire.

Hey bub, I don't need your kind of #$%^ either. I have a job; I work 35 hours a week to pay for my "ivory tower" community college.

Fair point. I don't always agree with the courts either. However, an expansive reading of the Commerce and Taxing and Spending Clauses is a matter of settled law. It isn't at controversy in the courts.

That's demonstrably not true. I'm not advocating some sort of revolutionary Marxism here. Those same European countries enjoy great political freedom. If you do it right, social democracy works well, and if you don't like it you're free to vote the proponents out. There are many examples of a peaceful transition to a more conservative government in social democratic countries.
