If holding "sham pro forma sessions every three days" keeps them in session then they are not in recess.

If you are going to be a lawyer you best learn that your wants and wishes do not trump the law.

Like most liberals , he ignores inconvenient sections of the constitution...just as Obama has.

Article 1, Section 5, Clause 4 of the Constitution says:
The Senate did not have the permission of the House, and vice versa.

The Senate was in session. Obama's "recess appointment" is clearly unconstitutional.

Bush derangement syndrome is alive and well. It matters not at this point for this discussion what Bush did. He is not in office.

Ignoring the spirit of the law is only OK when neocons do it?

He sure did set a precedent. You cannot yell about one, and tell everyone to shut up about the other.

He did a lot of things wrong but his name doesn't need to be in the picture every time Obama is mentioned. How come other Presidents who have done similar things do not get mentioned? Obama's issues are his alone regardless of what anyone else did.

I don't believe Bush ever made a recess appointment when the Senate was holding pro forma meetings and not officially in recess.

Pro froma meetings were invented by democrats for the express purpose of keeping Bush from making recess appointments during that time frame. It worked.

    With Obama, it didn't.

What is the "spirit of the law" that you are referring to in this case?

    I see none.

Congress is not in recess - no matter how you want to spin it.

What Bush did was pass Joe Biden's law that made it ok to pressure my library into releasing my borrowing history, which scares me every bit as this, believe me.
