I've been drifting in and out of this discussion over the time, and something just kinda hit me reading the last page today. The problem with the "marriage" is that they aren't living as married people. He's obviously not united with his wife if they are living separate lives. I don't want to go into if "married in the eyes of God" is real or not, or if they should get married in court or not. However, I think their actions do speak louder than their words in this case.

All we have are board meeting note - no contract or signatures were involved. I don't see why it isn't as easy as just having another board meeting and making a motion, seconding and undoing it, as easy as we did it.

I would think it depend on the wording. If it was said "We will pay into perpetuity until death" then no, if it just says something like "You will be the pastor emeritus and we will pay the pastor emeritus ___" then he'd lose it if he lost the title. It all depends on the specific wording, like others have said you have basically a verbal contract with a record (though I am not a lawyer so this is not legal advice).

What you have said is telling about the leadership in the church. They are unwilling to do what is right and take a stance against what is wrong.
