    Am curious about the poll numbers but even more curious about posts to see who you would pick.
    My top three are Scalia and Thomas, with Rehnquist a fairly close third. Not much surprise there, I'm sure.

    I didn't vote for Justice Thomas because he (from what I understand) does not participate in the give and take of oral arguments.

    After being raked through the coals in his confermation hearing, undergoing a "high tech lenching", as it were, Thomas is probably afraid to go on record about his opinions.

    Not really, as he is active when it comes to writing opinions. During orals, the Court asks the various sides questions. These questions do not always reflect a judges known thoughts on a given question.
