California Democrats Legalize Child Prostitution

I believe the spirit of this law was more about not saddling minors with a conviction on their permanent records, than it was about legalizing, mainstreaming, or promoting child prostitution.

It was borne of seeing these minors as victims of their pimps, instead of as criminals themselves.

 

The state of California has not legalized child prostitution, contrary to reports you may have read online recently.

The law, signed by Gov. Jerry Brown (D) in September, does decriminalize prostitution in the case of minors — an important distinction as the law aims to protect children by treating them as victims, not as criminals.

SB 1322, in fact, bans police officers from charging minors with prostitution. Law enforcement officials will be able to take minors into temporary custody but under limited circumstances — including if there is an imminent threat to their lives.

And sex traffickers will still be held accountable.

Yeah, I read your synopsis the first time around. You seem to believe punishing these minors is more important than rehabilitating them. Why classify people as minors and adults if there's no legal distinction?

Are most minors in the sex trade victims, or criminals? Are most minors in the sex trade freelance, or being forced into it by an older family member or pimp? How many minors in the sex trade are victims of human trafficking?

 

Let's look at a story from today's headlines:

The quick thinking of an Uber driver in his second month on the job helped police save a 16-year-old girl and led to the arrests of two women on pimping and pandering charges.

In a drive that took less than 15 minutes, Uber driver Keith Avila first noticed the girl in the front seat — who he took for 12 years old —was wearing a very short skirt that did not seem age appropriate, he told KCRA in Sacramento.

Then the conversation between the two women in the backseat tipped him off further, he said.

“First thing you want to do is ask: Do you have any weapons? When you’re hugging him, just ask, do you have any weapons? Pat him down. Pat him down while you’re hugging him. Get the donation, first. Before you start touching him, going in there, get the donation first,” Avila said the women in the backseat told the girl.

“We need to make this money. We need to make this money,” Avila told CBS Sacramento.

Avila said he dropped his three passengers off at a hotel and then called police. Elk Grove police credited him with the tip that led to the arrests of Destiny Tenaya Pettway, 25, and Maria Westley, 31. Both are from Sacramento.

Here we have a 16 year old being pimped out by a 25 and 31 year old. Obviously the deterrent of jail time didn't stop anybody. Should this girl now be charged with prostitution?

 

It depends, what if she murdered some one, should she be exonerated or tried as an adult, what if a 16 year old boy robs a bank with a sawed off shotgun, each case must be evaluated on its own.

If someone is truly a victim of the sex trade trafficking then NO, don't charge them, but if he/she are out on the street soliciting then YES and offer then rehabilitative help while they are incarcerated and off the street.

I believe Jerry Brown was WRONG in eliminating this law.

This is the way satan works his evil of lawlessness by using a controversial subject which could go either way depending on the circumstance then escalating it on the evil side to legalize social lawlessness like legalized murder (abortion and euthanasia), legalized marijuana, legalized gambling, on and on.
