Sounds like a case of bullying, which seems to happen too often in lawsuits.

A person, place, or otherwise doesn't have (or it would be much less painful financially and/or emotionally) the funds to fight the lawsuit, so they are pretty much forced to settle even if they are in the right.

Those putting these types of lawsuits into action, knowing this is the usual outcome and it will line their pockets like this, need to slapped with some type of fraud/embezzlement charges. Something! They know what they are doing.

From the linked article:

The Jackson City School District, located in Jackson, reached a deal on Friday after the ACLU, along with the Wisconsin-based Freedom from Religion Foundation, sued the district in February, citing “unconstitutional” actions and charging that students and visitors to the school “will continue to suffer permanent, severe and irreparable harm and injury,” according to the lawsuit.

And yet the ACLU will just as vigorously defend the open display of blatant, disgusting and perverse pornography. Tell me, how much "permanent, severe and irreparable harm and injury" does that do in comparison to the display of a picture of Jesus?
