Executive order overthrow 22nd?

    The 22nd Amendment to the US Constitution:

    Passed by Congress March 21, 1947. Ratified February 27, 1951.
    Section 1.
    No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once. But this Article shall not apply to any person holding the office of President when this Article was proposed by the Congress, and shall not prevent any person who may be holding the office of President, or acting as President, during the term within which this Article becomes operative from holding the office of President or acting as President during the remainder of such term.
    Section 2.
    This article shall be inoperative unless it shall have been ratified as an amendment to the Constitution by the legislatures of three-fourths of the several States within seven years from the date of its submission to the States by the Congress.

    Will Obama issue an executive order to circumvent the 22nd amendment and allow him to serve another term?

    Oh please, seriously, he would destroy any chances the Democrats have of national prominence for the same amount of time as Richard Nixon did to the Republicans.

    This isn't even the realm of possibility. Besides, SCOTUS would nullify it immediately and, if necessary, Congress would arrest him and place him under trial. Almost all Democrats would vote for his ouster.

    Not even a possibility.

    Someone might find a loolphole!

    Here is one - Mrs Obama runs for office - Mr. Obama is the VEEP candidate - they win - She takes the oath of office. - next day, she resigns - as Veep Mr. Obama is now the President. It is legal, because the amendment only say he cannot be elected to the office of the POTUS -

    Logic says no. But with Obama, who can really tell. He routinely breaks the law with EOs. He might give it a shot. All he has to do is convince democrats not to run anybody against him.

    They've been swallowing his malarkey for years. They might take a big gulp and swallow that load as well. :tonofbricks:

    1. The Supreme Court is MIA since they ruled that Obamacare was legal.

    2. The GOP are saying that there is almost nothing that they can do in Congress about the change of the immigration law by the recent executive order.

    3. The inability of the Supreme Court and the Congress to stop executive illegality says that Obama can do whatever he likes in the next two years.

    You know overriding a Constitutional amendment is an entirely different executive action than what President Obama did with immigration. Have you read his executive order? Or just listened to the blithe chatter from FoxNews? I'm being serious here.

    Could you please, for the rest of us, articulate the reasons why the President's executive action on immigration is different than a legislative action? There's a reason, legislatively, why the GOP can't curtail the executive action. For starters, the language in the EO is expressly limited to actions within the legal purview of the executive branch of government as defined by solid case law. President Obama didn't provide a sweeping immigration reform, but a properly limited action to speed along the pathway to citizenship.

    So what's the scorecard between the President and SCOTUS right now? Do you know? The executive action on immigration wasn't illegal. Only a fool believes that. In fact, it was entirely legal and not nearly as ranging as some believe. Your projection that he's doing anything he wants is sorely lacking. He isn't. In fact, about 85% of his agenda has been resoundingly turned down by Congress and/or SCOTUS.

    If you're going to make crazy claims, please understand the massive difference between executive actions on immigration and the actions like you're describing which are so entirely out of the realm of possibility that Hollywood wouldn't touch them.

    I dubt it. This has been a concern since Clinton was in office. Many accused of Clinton of getting prepared to call a state of emergency and martial law, extending his term. It never happened. Not that it won't or couldn't happen, I think this is always a concern for a two term POTUS, especially one that thinks he is King of the America's!

    I don't think you addressed the issues at all.

    1. The Supreme Court had a chance to declare Obamacare illegal and they did not. This is what I meant by they are MIA. Are you getting money for tours to DC or something? Is this brain surgery?

    2. There already has been a great deal of discussion about how Obama's acts differ legally in both scope and lack of precedent. Are you saying that anyone who opposes Obama is racist or fixated like the Dems here? The emperor/messiah himself said almost 2 dozen times that what he ending up doing was beyond the powers of his office. Obama granted amnesty and told Hispanics that he changed the law. Phyllis Schlafly said that this could lead to a civil war.

    You must think that Jay Sekulow is a fool because he said that what Obama did was illegal, as did another fool in your eyes the Dem. Sen. from Indiana (well, he is a fool), not to mention the law professor from Georgetown--another Democrat legal scholar.

    3. Since neither the GOP nor the Supreme Court can stop Obama and the Dems say that everything that he has done has been legal, Obama is free to do whatever he wants the next two years. And he will issue many more executive orders. Look for him to shut down 8 Indiana electrical plants next year with an executive order and close down most American coal mining with an executive order as payback for voting against him in 2014.

    4. It is clear from the Dems on this message board that the Dems still support Obama even though his popularity is dropping and uneducated white working people abandoned the Dems for the first time since they signed on in 1932. If Obama has done nothing wrong, clearly he can do some more things and the hardcore will find nothing wrong. I think that the main beneficiaries of the Dems policies have been blacks, Jews, and gays--all three groups in a golden age.

    Power corrupts and the Dems are corrupt but they don't care.
