President Elect dies

    If a person is elected President of the United States in November (December by Electoral College), becomes the President-elect, but dies before Inauguration Day January 20, who becomes President?

    Without researching I'd say either the VP elect or Speaker of the House, just my guess.

    The sitting Veep until Jan 20. Not sure after that.

    'If 'Veep' doesn't stick then after that would be Speaker of the House.

    Only if he was elected as the new Veep. What if a new President-Elect and Vice President-Elect were set to take office? The sitting Veep would be at the end of the term on Jan 20.

    For example, what if JFK had died on Jan 1, 1961? Nixon would have been POTUS for the next 19 days. Then what? Johnson? New elections?

    Yep, that's what I would say, VP elect and then the Speaker of the House. The Speaker of the House may be different than previous Speaker depending upon the election results. I believe Congress gets sworn in days or maybe a couple of weeks before the President.

    Succession goes like this: President, next in line is VP, next in line is Speaker.

    How do you derive that? Seriously I'd like to know. 'The people' had just voted the Dems to be in control, why would a Repub take over?

    The Speaker of the House is THIRD in command.

    My guess is if the President-elect died the Vice President-elect would, at noon on January 20, become Vice President and by virtue of becoming Vice President would immediately become President.

    Edit: Section 3 of the 20th amendment:

    Section 3. If, at the time fixed for the beginning of the term of the President, the President elect shall have died, the Vice President elect shall become President. If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a Vice President elect shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified.

    The Vice President-elect would simply become President.

    If Kennedy had died January 1, 1961, why wouldn't Eisenhower have remained President until January 20, when both Nixon and Eisenhower's term ended. At that point, according to the posts, Lyndon Johnson would have become President.

    I mistakenly confused myself. It happens. LOL

    Ike would still be president, not Nixon, but only until 1/20/61.

    I'm old. Forgive me. :tongue3:
