    Here's what happens when you don't stop when a cop is pointing a gun at you. This is also what happens when the policeman tries to be Dirty Harry. The cop should have pulled right up behind the car, blocking it from exiting the parking lot and then from behind the safety of his open car door demanded the kid to get out of the car.

    This was an undercover sting operation on the girl in the passenger seat, who was suspected of dealing marijuana. The two teens were on a first date. The cop is not being disciplined because an investigation concluded that he was in fear for his life thinking he was going to be run over.

    A local prosecutor in South Carolina said Tuesday that she would not bring charges against a police lieutenant who fatally shot a 19-year-old man during an attempted drug arrest in a Hardee’s parking lot in July.

    The case has drawn outrage in some quarters, partly because a private autopsy on the man, Zachary Hammond, who was unarmed, indicated that he had been shot from the side and the back, and through his car’s side window.

    That seemed to contradict the account of the officer who killed him, Lt. Mark Tiller of the Seneca Police Department, who said that he had fired two shots at point-blank range because Mr. Hammond had rapidly accelerated as he drove toward the officer, and that he would have been run over had he not pushed himself off Mr. Hammond’s car.

    Investigators refused for months to release video of the shooting from the officer’s dashboard camera. That graphic video was released on Tuesday, and it did little to mollify Mr. Hammond’s family or their lawyer.

    In it, Lieutenant Tiller is seen moving quickly on foot toward the driver’s side of Mr. Hammond’s car, which has backed up and is beginning to turn so it is parallel with the curb at the back of the parking lot. Then it begins to speed away. Lieutenant Tiller fires his first shot just after using his left hand to push off Mr. Hammond’s car near the driver’s-side mirror; he fires the second shot as Mr. Hammond passes him.

    Just ridiculous that somebody is DEAD over a non-violent crime. But folks think this is okay. Disgusting world we live in.

    Cop said he was about to be run over by the car and fired "head on" towards the car. Obviously that was a lie, and was the reason the authorities stonewalled releasing the video.

    The girl was found with 10 grams of marijuana on her. That is less than half an ounce. The other cop in the pickup parked next to the perp's vehicle said he did not shoot because he didn't think it was a life threatening incident.

    Guy gets out of car as ordered and doesn't try to run, he lives.

    Pretty simple.

    When are we, as a country, going to learn that Prohibition was, and is, a failure! All prohibition did was create a criminal underclass to fill the need for booze. And now we have created a criminal underclass to fill the need for MJ.

    Legalize it. Control it. Tax it. Lay off the entire DEA and every Narcotics Officer in the country. End of problem!

    I've strongly felt this way for years. I also believe it is beyond tedious and pointless for police to expend energy and resources trying to combat it.

    Cop pulls car in behind suspects car so it's impossible for him to back up. Calls for another squad car to help. Gets on loudspeaker and tells perp to exit vehicle. Undercover cop in truck next to perp's car is ready to assist. Other squad car blocks exit. Now cop approaches vehicle with hand on holstered gun. "You're under arrest. Step out of the car." etc.

    Playing second guessing police procedure expert again, I see. "Hand on holstered gun"? For a sting? Knowing one of the occupants is a criminal? Are you nuts?

    ...and the guy still attempts to drive off and is shot. Nothing changes. The only thing that could change the result is if he doesn't try to run. If he runs, he dies.

    Bottom line. No matter how it's done. He doesn't run, he lives.

    Running from the police isn't a capital offense.

    You betcha. The actions by the cop was wrong. A kid is dead. Second guessing is the proper response.


    Knowing the person in the car is a 23 year old woman suspected of being a pot dealer? I'd say that's about right. You will notice that the undercover cop did not draw his weapon, because he said, "I didn't feel it was a life threatening situation."

    .

    And how does he drive off if his car is boxed in?

    Thank you, voice of reason. Neither is selling pot a capital offense.

    But hey, he got what he deserved. Or as Carpro says, "Nice Shooting."

    But it could be fatal if the cop feels his life is threatened by it.

    How do you "box it in" with 2 cars?

    There were 2 police cars there. He ran before another could possibly arrive.

    He doesn't run. He lives.

    And it shouldn't be. That's just what the policeman's union attorney trains them to say. And that I feared for my life" phrase is reinforced in the time that they speak with the union attorney" and the time that they have to make a statement.

    Pull the squad car up at an angle so it's broadside to the rear bumper of the perp's car. Or if you watch the video, if he would have pulled up another 2-3 feet he'd have the car boxed in.

    There was one police car there. The other vehicle was an unmarked truck that was backed into a parking spot next to the perp's car.

    Cop doesn't shoot, he lives. The police knew who these two people were. They knew the girl who was dealing pot. They could have caught them subsequently to this blown bust.

    There are two phrases that have been misused by LEOs.

    The first is "for your safety and mine" as an excuse to violate a persons 4th amendment rights.

    The second is "I feared for my life" as an excuse for an unnecessary shooting.

    And compounding the problem of a lack of criminal and civil liability is "qualified immunity." If "ignorance of the law is no excuse" for the rest of us it ought to also apply to the LEO.

    If you watched the video, you will easily see how two police cars could have prevented him from going anywhere by using the woods and parking their cars at angles.

    "The "reasonableness" of a particular use of force must be judged from the perspective of a reasonable officer on the scene, and its calculus must embody an allowance for the fact that police officers are often forced to make split-second decisions about the amount of force necessary in a particular situation."

    It's the standard by which they are judged.

    The simple fact that you keep parroting that one liner in a country that is the leader of the free world is indicative of a problem.
