    She should, without question or delay, recuse herself from any case in which she had an administrative role prior to her appointment.

    From the article:
    A federal judge is required by law to recuse himself “in any proceeding in which his impartiality might reasonably be questioned.”
    (bold emphasis mine)

    Since the judge is a she and not a he, would that be a technicality?

    Hmmm....that sounds like a euphemism for "no".

    Sort of like when you asked your Mama if you could invite a couple of friends over for the weekend and she let, "let me think about it." If you are like me, you knew what that meant.

    If you are a bit short on "judicial ethics," then I guess you're off the hook.


    Not to mention...why should Kagan recuse herself? Who will expand the "commerce clause" if she doesn't? :)rolleyes:)

    This (in)Justice is dirty. I look for bad things from her.

    (But seriously, there's probably nothing impeachable--yet. Although with Kagan, It's likely only a matter of time before all manner of unconstitutional decisions start flowing...)
