Making threats against others is not protected speech.

 

So if someone says they are going to kick your behind they should be arrested?

 

In most U.S. jurisdictions it is a misdemeanor unless a weapon is involved in which case it is a felony.

 

[SIZE=+0]Yes but the problem is that such laws are laws of convenience. They are only enforced when it is politically correct or someone is singled out. I am reminded of the black panthers and the Tyron case where they called for assassination and nothing was done. [/SIZE]My question was this the intent of the original founders of the constitution? Why could it not be considered a threat to tell someone they will go to hell if they do not repent? It is a very vague law.
