The D.C. Courts have called Obama on one of his lies

    Two religious-affiliated colleges claimed a "major victory" Tuesday after a federal appeals court ordered the Obama administration to verify that it is revising the so-called contraception mandate in ObamaCare.

    The decision out of the D.C. Court of Appeals effectively reinstated a challenge that had been dismissed by lower courts. Wheaton College and Belmont Abbey College were arguing against the federal health care overhaul rule that requires employers to provide access to contraceptive care.

    The Becket Fund for Religious Liberty, which has represented several plaintiffs challenging the rule, hailed the court decision.

    "The D.C. Circuit has now made it clear that government promises and press conferences are not enough to protect religious freedom," Kyle Duncan, general counsel for the Becket Fund, said in a statement. "The court is not going to let the government slide by on non-binding promises to fix the problem down the road."

    The court ruling did not overturn the contraception mandate. Rather, it effectively put the court case on hold while requiring the Obama administration to follow through on its pledge to revise the mandate as it pertains to religious-affiliated groups.

    "We take that as a binding commitment," the court said in its ruling Tuesday. The court ordered the administration to file status reports every 60 days on its progress toward issuing a new policy in the first quarter of 2013

    So the D.C. Appeals Court took Obama's promise as a "binding commitment".

    Aside from the fact that the Fox News report, as usual, got most of the details wrong, and drew a conclusion based on a spokesperson's statement rather than on the court document itself, the fact of the matter is that administration response to the contraception mandate was triggered in September by the US Conference of Catholic Bishops' letter, and the initiation of the mandate was delayed by a year, to allow the courts to rule and to determine the nature of employers related to religious institutions.

    Actually, churches and individuals directly employed by them are exempt from the conception coverage mandate. The distinction between "directly employed by the church" or "indirectly employed by a church-related institution" is, for Catholics, a dilemma because the standard that has been applied is Title I, and receipt of federal funding. I would guess that Wheaton and Belmont-Abbey take federal educational grants on behalf of students. Perhaps they should follow the example of, say, Hillsdale, which doesn't accept federal grants in aid and is thus, exempt under the provisions from having to provide contraceptive coverage. Nonetheless, there is a delay so that the courts can make these decisions. No lie involved.

    Oh there was a lie to be sure. Obama promised he would fix this later. Much like his other current lie "Give me taxes ont eh rich now and I will cut the deficite more later.

    But to be fair to Obama he is not the only Marixist to make this lie. It is a common lie among the far left.

    He did exactly what he said he would do--delay the mandate to give the courts time to decide who qualifies for exemptions on religious grounds. Your continued misrepresentation of the President, along the lines of other right wing extremists of your ilk, completely destroys your credibility.

    No, he lied about both the exemption fix and cutting spending. The courts have called him on his bluff and demanded it be resolved immediately. They are holding him to his word. About time.
