No Black Nurses

    A hospital recently honored a fathers request not to have their baby to be taken care by a Black nurse.
    A lawsuit has followed.

    So, does a patient have the legal right to determine who handles his health care?

    Legally, who should win the lawsuit.


    Noticed, I bolded legal right - this is not a discussion on morals - only the legality of it.

    Not just NO, but a No to the nth power. In this case, the hospital is the loser. Just as it would be if it allowed an employee or doctor to discriminate on who they would treat based on race.

    I would contend that a patient (paying with his own money) has the absolute right to have a medical personnel of their choice.

    So that means someone on Medicaid or in the military must take whomever they are assigned to.

    When looking at this subject, from the standpoint of who's paying the bill, I agree with you. Whether getting medical treatment or getting a haircut, I should have the right to decide who touches my body or the bodies of members of my family. Doesn't matter if it's red-heads, fat doctors, nose-ringed attendants, or people with blue eyes, I should have the choice, as payment for service is coming out of my pocket.

    Agree with the opinion that the payer should decide.

    The nurse's lawsuit, which appears to be motivated by the prospect of easy money, is ridiculous.

    While the consumer does have the right to request doctors, nurses, teachers, lawyers,..... of their choice, I would have to say that when he TOLD the head nurse in charge that he wanted no black nurses tending to his infant and then he pulled up his sleeve and showed his swastika tattoo ....

    ....maybe it's just me, but I would have perceived that as a threat - to me as the white head nurse, to my black nurses, and all my nurses in neo-natal.. I, as the head nurse, would have called the sheriff's department post haste.

    I would have complied with a verbal request (while telling him very compassionately and kindly exactly what I thought of his request), but the racist tattoo in my face is another story altogether.

    As to how this black nurse was harmed? Well, for one thing, the note on the baby file that read "No African-American nurses .... "

    Really?!? :BangHead:

    Should all the black neo-natal nurses been contacted personally and explained the situation? Um ..... yes! The note would have merely been a back-up if the father filed a complaint.

    Such disrespect.



    She, as an employee of the hospital, - and the same as all the white nurses - should have expected from her employer:
    • the same respect as to her job performance/human dignity as any white nurse.
    • A PERSONAL contact made by her supervisor and head nurse explaining that her PERSONAL job was not in question, she was merely being protected from an insane idiot.
    Should she sue? Probably not.

    If I were HER, I would have made a bee-line to my supervisor requesting a conference and I would have explained how finding a note made me feel and she and I would have discussed, until I was satisfied, a better option for notifiying the black nurses the next time racist jackass comes in and says something like that.

    Just my two cents this morning.

    The hospital does not have to comply with an ignorant request.

    Lets not make it just a hospital ,
    suppose at a convenience store, a customer said " I will wait for the white clerk. If the store does not comply - he can always go across the street to the other store). Remember the customer is always right.

    If the store wants the mans business, they will comply.

    Remember, we are talking about the legality of all this - not the moral aspect.

    For the moral aspect, lets discuss that on this BB discussion

    As I've previously mentioned, I was born with a physical limitation. Over the years I've had to make a choice. Over and over again, BTW.

    Run crying to someone every time I've encountered discrimination. Every time I've been on the receiving end of cruel jokes. Every time I've seen rejection in the eyes of a potential employer upon entering his office for an interview. Every time I've heard a child ask his/her parent about me.

    OR

    I could accept that there are people in this world who reject anyone who doesn't meet their "standards". At some point in my life, I realized that my Saviour was rejected, too. Did He call for conferences? Did he demand discussion until He was "satisified"? Did He demand "better options" from those who surrounded Him -- those who nailed Him to the cross? He who could have spoken and returned EVERYTHING to what it was before Genesis 1:1.

    In closing, when I consider what Jesus endured on my behalf (and ALL others who will accept Him), what I've endured during this lifetime by those who discriminate is NOTHING. So what, if I encounter more of the same in the morning. It's a fleeting instance, so small there is no time comparison with the prospect of spending ETERNITY with HIM.

    Brother, what you say is completely true about the choices we make. I have a brother - my only sibling - who has been on the receiving end of discrimination multiple times in 50 years and it's painful and maddening. I learned a long time ago to appreciate those who treat him kindly and let it go with those who don't.

    This nurse can't do anything about the man who is a racist and who brought all this ugliness to her hospital floor.

    But the nurse's supervisor handled it incorrectly. The black nurse shouldn't have found out about this by a chance reading in a file.

    I've had to - as a lead teacher - stand between (metaphorically speaking) a black colleague and a racist dad - more than once. I've also had to stand between a couple of naive male colleagues and lonely/recently divorced mothers. I kid you not.

    When one is given authority over others, one must know to watch out for people and to personally intervene with a "heads up" or at least standing up with/for them. If I were ever negligent in that, you can better believe someone would call me on it.

    I am assuming:

    1. That the various anti-discrimination ;was would forbid race based care.
    2. The father is paying for it himself. More than likely it's his insurance company or MedicAide. If the later, most definitely point 1 is a consideration.
    I am surprised that this occurred in Flint, Mich.

    Golly!!!! I could not imagine someone doing that here......they would probably be shown the door for being a racist.

    When I nursed, a couple of times a female patient would ask if she could have a female nurse to assist with ablutions. When bed bathing, I never saw the patient totally starkers as you uncovered a portion of body from a towel, washed and dried and recovered. Obviously, the most personal part of the body would also get washed, but if the person was able to they were often pleased to attend that area rather than a stranger. With showering, most folk if they could would wait for a spouse or significant other to assist.

    The National Socialist Movement, the largest neo-nazi group in the U.S. right now (not skinheads) is headquartered in Detroit, Michigan. And according the the Anti-Defamation League, most of the neo-nazi groups in the U.S. are in the northeast region. That surprised me because I thought they were mostly in the mid-west to northwest region.

    I'm not saying the man in question is a member of the NSM or is a skinhead racist, but if he's wearing a swastika tattoo and showing it off, he definitely not the typical prejudiced person - he is a literal racist.

    Also, according to the ADL which keeps close tabs on skinhead racists groups, these neo-nazis can be found in virtually every state, but the following states have the most by population and activity.

    So in this instance would the patient be considered a sexist?

    Mrs Salty works a hospital and has seen requests on the charts of "No Female or (Male) to take care of this patient.


    When I was a taxi driver, there were times only a female driver could pick up a Muslim because the patient was a woman. Should the taxi company be required to abide by the request?

    Any other examples?

    I did not mean I was surprised by the father's "orders". I was surprised the hospital complied with them.

    The real point is this, does the government have the authority to compel one to receive services from someone to whom he objects for any reason?

    If taxpayer's money is involved, all kinds of anti-discrimination/segregation laws and regs kick in. This is 2013 not 1913 or even 1963,
