Missouri set to nullify federal gun laws

The Republican-led Missouri Legislature is expected to override Gov. Jay Nixon’s veto of a bill that would expand gun rights and make federal gun regulations unenforceable -- even as similar laws adopted in other states to buck federal gun rules face legal challenges.

Several of Nixon’s fellow Democrats told The Associated Press that they would vote to override his veto when lawmakers convene in September, even while agreeing with the governor that the bill couldn’t survive a court challenge. Many of them noted that in some parts of Missouri, a “no” vote on gun legislation could be career ending.​

The Missouri bill is different from other nullification efforts nationwide, and even different from the Colorado and Washington efforts to nullify federal marijuana laws. The Missouri law would be unique in prescribing criminal penalties for federal agents who attempt to enforce federal laws that act in contravention of the Second Amendment.

Nixon vetoed the law in July, stating he believed it violates the Supremacy Clause of the U.S. Constitution. However, that argument was struck down in federal courts when 25 states outlawed enforcement of the Bush administration's REAL ID law within their own boundaries. Their viewpoint was upheld.

The Missouri nullification bill does not violate the Supremacy Clause, according to several legal authorities both in Missouri and elsewhere, since the former is meant to protect a constitutional right violated by the federal government, namely the Second Amendment.The Supremacy Clause is usually applied in defense of the Constitution, for example if Missouri tried to re-enact slavery or ban women suffrage. Nixon's refusal to sign the bill was based on bad advice from his staff counsel.

I'm a Missouri native, living in Kansas against my will (my wife won't move :smilewinkgrin: ). I'll be happy to see Missouri nullify a ridiculous effort by the Great Pretender's administration to nullify the Constitution.
