Baltimore DA lying about Gray's knife?

"The State baldly asserts that 'the knife was not a switchblade knife and is lawful under Maryland law,'" Zayon wrote in the motion filed in Baltimore District Court. "The State further suggests that the Defendant 'failed to establish probable cause for Mr. Gray's arrest, as no crime had been committed.'"

Zayon contests Mosby's claim that officers illegally arrested Gray, and he said an inspection of the knife will show it was illegal.

State law says a person may not "display" a "switchblade" or a "knife or a penknife having a blade that opens automatically by hand pressure applied to a button, spring, or other device in the handle of the knife."

Baltimore City code says a person can't carry or possess any knife "with an automatic spring or other device for opening and/or closing the blade, commonly known as a switch-blade knife."

A Baltimore police task force, commissioned to investigate Gray's death, analyzed the knife and determined that it was "spring assisted" and in violation of the city's law.

The prosecutor, whose husband is elected to the city council and who is best friends with the defense attorney, has not released any photos of the knife so one thinks that she is lying.

Even liberal Alan Dershowitz says that the charges are outrageous and irresponsible:

Dershowitz added that the charges did not meet the criteria for justice in the United States.

"It may have been the criteria in Rome, for Fidel Castro, in Iran, and in other countries, but in our country you don't base indictments on what impact it's going to have on the crowd," he said.

"You base it on a hard, neutral, objective view of the evidence, and it doesn't look like that was done here . . . They have invited a mess. What they did is they bartered short-term results today for long-term problems in the future.

"My prediction? They've overplayed their hand, it's unlikely they'll get any convictions in this case as a result of this, and if they do, there's a good possibility it'll be reversed on appeal and will just postpone the riots for months ahead."

Fortunately the case doesn't hinge upon the knife.

You can't chase someone, pin them to the ground, search them and then then arrest them for something you couldn't even see, while levying no charges to justify chasing him and pinning him down in the first place.

The entire department needs to be under investigation if this is what they do.

Sorry Charlie.

Fleeing from the police is probable cause to detain and search.

And by doing away with the false arrest charge, it damages the DA's credibility even more than it already is. The entire case hinges on a proper arrest.

Everybody knows the murder charge is a bogus charge made to mollify the public. Plus, when it is proven she lied about the knife. What else is she making up?
