A new bill approved by the state House will legally protect motorists who hit protesters blocking the road—as long as they “exercise due care,” according to The News & Observer in Raleigh.

House Bill 330 was approved in a 67-48 vote late last week. The bill was drafted in response to protests in Charlotte that paralyzed traffic last fall.

“I became concerned for drivers after watching the recent protests which turned into riots in Charlotte and other cities,” Republican Rep. Justin Burr, the bill’s sponsor, said to Fox News. “In a number of cases the protests turned riots resulted in violence and the terrorizing of unsuspecting motorist, their passengers and property.”

“I strongly believe North Carolina should protect law abiding drivers from facing civil liability if a protester is injured while attempting to illegally block traffic on a public highway or interstate.”

It's a SHAME umpteen "laws" are seen as "necessary", when "laws" already cover ...

Rights to "protest", "according" to the law/rules OF protesting ~
which NEVER includes blocking traffic, destruction of property, touching or harming another person or their property.

There are already in place "laws" for "unruly" / "unauthorized" gatherings of people in "public" domains...AND squads of trained personal to swiftly and force-ably deal with such "unruly" people.

It is the twisted "court" system and conniving lawyers and ignorant jurors WHO allow frivolous lawsuits to proceed ~ in such manners that the "instigator" who becomes "harmed", is awarded damages! Ludicrous!

(be it an unruly protester, a burglar, thief, etc..... totally ridiculous they are ever considered to be compensated for harm they endure AFTER their own commission of assault)

Protestors WHO "block" public roads...'block" public "door" entrances/exits...etc. is an OLD cheap tactic of "women protesters against drinking"....of "unions protesting their own employers"...of "political supporters attempting to disrupt supporters of an opposition".....etc.

As long as there are people willing to ignore what is right, there WILL be people who ARE "lawless"...and opportunity for yet another NEW law, that the "lawless" will attempt to skirt around with the aid of a conniving lawyer, pacifist judge, and ignorant jury.

The words "due care" made the law worthless. You can't show "due care" while running over someone with a vehicle.

That is like saying no one will be shot if a "stand your ground" law is passed or passing a law permitting concealed guns in schools or on college campuses.
Torally different circumstances. Due care which is most commonly called due regard in court proceedings is for all practical purposes a catch 22. It always boils down to if you had shown due regard, an injury would not have occurred. This is the same standard law enforcement has to meet when operating a vehicle in emergency mode. Pretty much any time there is an accident, the agencies insurance company settles because they always lose the suits when they do go to civil courts.
