I think the 9th Circuit has been demonstrating that under a strong majority of Progressives that they will abuse their power to further their political agendas. A stronger Conservative presence will help keep this in check whereas a Conservative majority would bring the court back into upholding the Constitution and away from legislating from the bench rather than flip the abuses of Left over to the Right therein doing the same thing in reverse. But, yes, putting the 9th Circuit's focus back on their true responsibilities would be a huge hit on the Progressive's war machine.

While it's true that it turns out the Ninth Circuit being liberal is a working out of the checks and balance venue I'll be glad to see it get flipped.

The Liberals have a similar distressing view of the SCOTUS leaning conservative, too bad :).
OH MY what will they do when President Trump has to replace the retiring Justice Ginsburg!?

    Mass hysteria.

    Imagine this : 2020

    President Trump reelected.
    Republican Congress.
    Republican Senate.
Amy Barrett to replace Justice Ginsburg.
    Ninth Circuit flipped.

    From the decision:
The harms that Plaintiffs would likely suffer if a stay is granted are comparatively minor. The main potential harms that Plaintiffs identify are based on their prediction that implementation of the Final Rule will cause an immediate and steep decline in the number of Title X providers. But these potential harms obviously rely on crediting Plaintiffs’ predictions about the effect of implementing the Final Rule, over HHS’s predictions that implementation of the final rule will have the opposite effect.

Other than that they are in the “family planning” business mainly for the money to be made murdering babies in the womb, is there a reason that there would be a sudden drop in provider participation under the Final Rule?

It is strikingly clear that this is a battle between good and evil. I am heartened by their decision, temporary though it is.
