Those posts keep getting it completely, perversely backward.There is no Constitutional document that forbids it.
Constitutionally speaking, the federal government needs explicit laws in order to act. However, any law that would permit the violation of rights is unconstitutional by definition. The Tenth Amendment was added to make sure this was understood.
While the Bill of Rights explicitly states certain rights—and thank God he so ordained—it neither grants those rights nor implies they are the full extent of rights, rather those rights are inherent and explicitly recognized as such.
