    His knee on the victim would not have been a problem if it had been on his upper back just below the neck. That would have held him securely to the ground. Surely all LEO's know in this day and age to avoid any putting any pressure on the neck or a choke hold there - such a thing is just too dangerous.

    If the report is that he died due to lack of air/strangled, cop should be charged first degree murder!

    He can't be charged with 1st degree. 1st degree is when you have planned on and intended to kill someone. You ordered materials for a bomb, or you stalked your victim for a week to see their routine, or you went and bought a gun for just that purpose, or you kept a journal of your plans to kill them. That can get you life or even the death penalty.

    2nd degree is a "heat of the moment" thing. Say you are a hot-headed and jealous man. You and your girlfriend are in a bar. A drunken man stumbled near your girlfriend and reaches out and grabs her in an inappropriate place or places. You, [not literally YOU], in your mindset of instant anger and rage, shove him to the floor and bash a beer bottle over his head and choke him. You didn't plan it, but you did kill him in the heat of the moment with an intent to bring great harm.

    3rd degree is when you place another person in danger - you put them in harm's way.- and they cannot get away AND you, with an indifference to their peril, cause their death. It's called unintentional.

    The key phrase in the formal charges is "evincing a depraved mind, without regard to human life". This was the key to Mohammed Noor’s conviction of shooting the Aussie woman, Justine Damond.

    I'm not a lawyer but 1 second of "wait time" after realization of immanent death on the part of the officer could bring a first degree charge in this case.

    a jury must decide and then further decice for the death penalty or life imprisonment.

    Think it becomes premeditated once the person realizes that the man was nearly dead, and yet refused to cease activity!

    Possibly. It will depend on the lawyers, jury (or judge?), evidence allowed, etc. But now I’m wondering if even a charge of manslaughter will stick, or carry much of a penalty.

    It seems those working for the bereaved are unintentionally creating a credible defense by saying many police believe that if you can talk, then you can breathe. With no evidence of traumatic asphyxiation, they are already creating reasonable doubt. It’s already hard for one to believe a cop would just kill someone right in front of witnesses videoing, the protesters excepted—they’ll believe anything.

    Well, now there's two conflicting autopsies out there and they both lack a little credibility to me - the official one could just be covering for the cops but that ME said Floyd had pre-existing conditions but wasn't strangled to death. The other one is by a whackjob that has a history of making outlandish claims - Mlke Brown was possibly shot in the back. Jon-Benet was participating in family sex games at her time of death, Epstein was murdered. He says, no, George was strangled to death and the other ME said there was absolutely no physical evidence indicating such. Also that George was in good health.

    It's true that you usually can't talk during an asthma attack, but that's because of the exhale. As I said before, he was complaining about not being able to breathe long before this cop and his knee came along, both autopsies claim George had fentanyl and meth in his system . . . with a heart condition?

    If as the video suggests, the officer knelt on his neck for 8 minutes, it would't matter much if he had underlying health issues, he would still be dead. There was a similar case over here some time ago. The difference is that here an officer would be immediastely suspended and if he wasn't charged immediately, the independent police commission would take over the case and investigate. We wouldn't try to cover it up.

    Well your chances of recovering from underlying issues pretty much drop to zero if the officer serving and protecting is ignoring pleas for care and actively harming you. Lol.

    I take back everything I said about the second autopsy - the doctor didn't even look at the body, just the videotape and interviews with George's family. So, he may have never admitted to the drug use or his health problems. This is the real autopsy:

    Autopsy report: George Floyd died from cardiopulmonary arrest, was positive for COVID-19

    "died of cardiopulmonary arrest complicating law enforcement subdual, restraint and neck compression."? And "no life-threatening injuries", yet this ME does say that it was a homicide? Go figure.

    They call an ambulance before the knee thing, this is so strange - one cop tells him there's no pulse and none of them react at all? I have heard the Elison is deliberately overcharging, an acquittal will be forced and then rioting will ensure right before the election. What is he thinking with the 2nd degree murder charge?

    You should wait for the court case, if it ever goes ahead, then listen to the evidence. But I have no doubt he will get off. They always do.
    As for trump telling the states to get out and dominate like some third world dictator, after hiding in his bunker for 2 days. He would have done better to come out and address the crowd and ask tghem to send two or three to come and put their complaints to him.
    Then putting troops of the streets of the capital against his own people, Using them to clear the streets so he could walk to a closed down church and stand outside for a photo shoot, waving a bible. As the bishop of Dover said "If he had actually read that bible he waved around, he may have acted differently.

    WOW!! Would you please reference this "command"?
    I really thought that telling the states to do their job was preferable to Trump trying to do it for them; but looks like they are not, so he may have to!!!
    Much rather they handle their own affairs. If they could guarantee that their terrorists would stay in each one's own state, then let em alone!!!!

    You’re not from around here and get your news from dubious sources, so you may be unaware that Trump has been working tirelessly to improve this country for every American, except those siding with enemies determined to destroy it.

    Unlike his predecessor, Trump has worked on several prison reform initiatives. He has improved employment opportunities for millions through economic reforms and employment training.

    They didn’t have to wait for an incident to appeal to him. That isn’t what this is about. These people are anti-America, anti-constitution, anti-republic—useful pawns for certain anti-Trump entities.

    All you have to do is follow their wants/plans for the govt (their control), see their reaction to disasters, look at their morals - they are VERY obviously following the directions of their daddy!!
    They are totally anti-Christian, anti-America, anti-moral.
    Get some info from sources other than whatever you are getting it from now!
