A Missing Witness Charge

The DA stated that he felt that the daughter lied in the first trial

So, the link says the daughter is now an assistant prosecutor working with her father’s defense.

That explains why she wasn’t called as a witness. She is an attorney, essentially working for the defense.

Which makes the “missing witness” designation even more dubious. How can you call a defense attorney as a witness?

I know he was convicted, but I didn’t hear what the judge ruled on the “missing witness” request.

If he granted that request, it seems clear it would be grounds for appeal.

There is a bit of confusion.

The daughter of the DA does work for the DA office as an ADA

The daughter of the accused (now convicted) does NOT work for the govt.

Your are correct. When I read “his daughter” I thought it referred to the defendant since I was looking for some reason why the daughter didn’t testify.

Surprising that some nepotism law wasn’t broken with the DA hiring his own daughter as an assistant.
