They were arrested taking part in the immigration rally that was based at the mall which garnered attention for being closed to veterans as part of the government shutdown.

They must have asked to be arrested. During a session of Congress, members of either house can only be arrested for treason or other felony, or breech of the peace. The last was not the charge levied against them.

Lets see - Rangel - need we say more?

Lets see, we could deploy extra LEO and other govt workers for this event, but we cannot pay the required death benefits to the families of militar personel?
