Discretion in sentencing sex offenders

    Wait a minute. A 16 year old boy has consensual sex with a 15 year old girl. For all we know she could be days away from turning 16 herself. And you say this boy should rot in jail for the rest of his life???

    What about the girl? Why shouldn't she also "rot in jail"???

    What if this were YOUR son? Would you still want him to rot in jail? I think not.

    Mandatory sentencing is the result of rapists and murderers being released back into society and raping children and then murdering them...at least one of these children were buried alive. I say if our judges are not going to show judicial common sense, then they should lose their discretion. I knew the soft on crime libs would react this way which is why I moderated to life in prison. The soft on crime libs don't care about the countless victims of rape and murder. They are worried about the precious civil rights and "persecution" of the rapist and the murderer. We don't have time to wait for new judges. We need to reign them in and hold them responsible for the repeat offenders they loose on society to brutalize and murder our children.

She is the one who was raped. That is just typical of the soft on crime attitude to blame the victim while standing up for the rights of the criminal.

    Some states yes. Some states no. Different states have different ages of what is considered to be minor.

    I don't know where you grew up, but I wasn't having sex at 8. You talk as if this is normal. What kind of sick, twisted world did you grow up in?

    If an 8 year old rapes a girl, and it can be proven to be non-consentual, off to prison for life with him.

    </font>[/QUOTE]Yes. Sick and twisted in sin. The Christ who is within me is greater than the hormones which tempt me to sin. Everyone is able to abstain. God does not tempt us beyond what we can handle. But, he also provides forgiveness. But, that also doesn't mean he takes away the consequences of the sin in this life. You will pay a price and justice will be served.

    For you to advocate life imprisonment for a 16 year old boy having CONSENTUAL sex with his girlfriend, is far beyond the pale. Half (and I'm betting more) of the students in our nations high schools would be jailed.

    If they break the law and get caught, yes this would be true. My guess is that this would be an incentive to actually obey the law. If you don't like the ages of statutory rape in your state, then do what you can to change the laws. I don't like the discretion that judges are given to release rapists and murderers back into society so they can brutalize and murder our children some more. Therefore, I am going to do what I can to take that discretion away from them, to protect our children. I don't care that much about the rights of the rapist. I care more about the safety of our children.

    I take serious offense to this Joseph! First, let me say that I believe sex is for the marriage bed ONLY and I waited til marriage.

    In Georgia, a pregnant girl can marry AT ANY AGE, as long as she can prove she's pregnant. She can marry her first cousin, too.

    A couple aged 16 can marry if one parent signs for each. Under 16, they can marry if they go to court and get permission.

    If this boy and girl had both been under 16, they could have had sex all they wanted. If the girl had been 16, no penalty.

    For a couple of teens to sin, they need some talking to but not jail for the rest of their lives! Whose to say the sex didn't start when the boy was 15 or the girl didn't coerce him?

    Aparently the courts said so. Be offended if you want, but if you break the law, then you should pay the consequences no matter how old you are. I stand by what I said.

    As a kid, Did you ever steal a candy bar? Ever use a car without permission? Ever peek in someone's windows? Ever cheat on a test?

    Fornication, yes. Stautory Rape? No.

    There should be an age span/ limit. I'd think a years difference or mental capacity problem but not a girlfriend, boyfriend so close in age. This boys life is ruined. He's a registered sex offender now!

    A man applied to work at the company where Jim works and his record showed basically the same thing. No job.

    Yes. And he is the one who has ruined his own life. As I said, if you don't like the age limits for statutory rape in your state, then work to change the law. I don't like the discretion our judges have to release repeat offenders back on the streets to brutalize and murder our children. Therefore, I am going to work to change the law and take away that discretion.

    So, you are making the moral equivalency argument. Tell me, do you also agree when that argument is used to compare the war in Iraq with the terrorists acts in London? Sorry. But, someone who cheats on a test in high school is not the same as someone who commits rape, and you know it.

    I wil go a little further.

    1st Offense: Death or Life in Prison without parole.

    Children who have been sexually abused are scarred for life and it is a proven fact that pedophiles cannot be reformed.

    No Joseph, I was trying to show a moral equivalency of a couple of teens (probably not raised in Christian homes) having sex and teens doing other stupid things. They're called children for a reason!

    This was NOT rape. No idea about this girl but she readily admitted she was not raped or cooerced.

    I've seen very young girls at Wal-Mart who were acting out sexually and dressed in ways that gave me the impression they were looking for boys. Our 28 year old son has been approached by many girls in their teens who wanted to 'date' him. Georgia has a horrible track record of teens having sex by 14. To put this young man away for 5 years for having sex with his girlfriend while the boy who killed the 8 year old in his trailer park can only get 2 years in the same detention center is horrible.

    Personally, given jailhouse justice and what happens to child molesters in prison, I'm not too unhappy with serious prison time. Mercury and Diane are right, there are circumstances that fit on a lighter end of a spectrum, but it's a short spectrum. In the stereotypical situation, older man molesting a child, lock him up and throw away the key or fry him.
