The Department of Justice is asking a Boston federal court to dismiss the legal action against the nation's Defense of Marriage Act.
In making the request, the attorney general's office told the court the law defining marriage as between one man and one woman is "constitutionally permissible," but is unfair and ought to be repealed.
Mat Staver, founder of Liberty Counsel and dean of the Law School at Liberty University, tells OneNewsNow that approach falls far short.
"We are working on looking at other means to have our own defense of this particular case because you can't go into the court and say that the law is discriminatory, but nevertheless it's permissible -- but that's what the Department of Justice has done," he points out.
