    What exactly is the judge saying here?

    That he cannot declare a mistrial on that basis?

    That he is afraid to declare a mistrial on that basis?

    That the jury might return three "not guilty" verdicts?

    verdict 'overturned' on appeal. They are assuming a guilty verdict.
