Federal judge strikes down Utah's same-sex ban

SALT LAKE CITY – A federal judge has struck down Utah's same-sex marriage ban, saying it is unconstitutional.

U.S. District Judge Robert J. Shelby issued a 53-page ruling Friday saying Utah's law passed by voters in 2004 violates gay and lesbian couples' rights to due process and equal protection under the 14th Amendment.

Shelby says the state failed to show that allowing same-sex marriages would affect opposite-sex marriages in any way, and the state's unsupported fears and speculations are insufficient to justify deny allowing same-sex marriages.
The LDS aren't going to react well to this. I've thought all along Shelby was a "plant" by the Great Pretender with the express intent of putting him in the position to hear a challenge to Utah's law. And now he's heard it, and ruled. :BangHead:

I wonder how this judge would rule if a polgamny marriage case came before him?
I may be mistaken, but I believe he was the law clerk for Judge J. Thomas Greene, who ruled on some matters in the FLDS criminal cases ... ?? Not sure about that, but if that's the case, it is more than a little ironic.

Don't worry, the same logic will be use to have Poligomy officially allowed in Utah now, as we continue to redefine what marriage means!

THAT will excire the Mormon faithful, and bring them "out of the closet!"
