Gays Fight for One Simple "Word"

    And yet 'society' is (possibly) deciding that it wants to widen the definition of 'marriage'; 'society' is deeming it 'socially desirable' to to widen that definition.

    As to the Wills point, surely the conclusion is that everyone should make a Will rather than leave it up to the State to sort it out?

    You are mistaken. The First Amendment states simply states: Congress shall make no law respecting the establishment of religion or prohibiting the free exercize thereof;. The significant word is Congress. The Constitution states nothing about the States ability to establish religion though the First Amendment has been interpreted as such.

    I never have said that the Constitution states that the US was founded on Judeo-Christian values but anyone cognizant of our history is aware of this fact. Historian and former Speaker of the House, Newt Gingrich, has recently published either a book or DVD demonstrating this truth.

    Not all marriages are performed by church officials. The remainder are performed by government officials. There is such a thing as common law which as a resident of England you should be aware. Common law in this country establishes marriage as the legal union between a man and a woman.

    The Constitution prohibits Congress for "respecting an establishment of religion" meaning the establishment of a national church. The intent was to not interfer with the States many of which had state religions and did not want the federal government superceding their rights to do so if they saw fit nor to impose one denomination over an other. Each State wanted to remain free to make their own choices. The Warren court misinterpreted this part of the constitution as if it had been applied to all government branches and all governments thereby taking away the very rights of the States that were originally protected by the amendment.

    The States have a right under their own constitutions to legislate and enforce law for the sake of justice and to impose morality including those based on the teachings of the Holy Bible and to do so with due recognition to that basis. Marriage is a union of one man to one woman before God to be recognized and defended by goverment. Homosexuals have no right to such a union and the State has every right to prohibit it. The Constitution was not written to prohibit this. The people of the times were right but the modern Supreme Court was wrong. That misunderstanding is now being extended even farther and deeper.
