From the article:
A federal judge is required by law to recuse himself “in any proceeding in which his impartiality might reasonably be questioned.”
(bold emphasis mine)

Since the judge is a she and not a he, would that be a technicality?

Asked if she would recuse herself, Kagan told the Senate she would be “carefully considering any arguments made for recusal and consulting with my colleagues and, if appropriate, with experts on judicial ethics.”

Hmmm....that sounds like a euphemism for "no".

Sort of like when you asked your Mama if you could invite a couple of friends over for the weekend and she let, "let me think about it." If you are like me, you knew what that meant.

An important issue:

Recusal arises as a matter of judicial ethics...

If you are a bit short on "judicial ethics," then I guess you're off the hook.

Not to mention...why should Kagan recuse herself? Who will expand the "commerce clause" if she doesn't? :)rolleyes:)

This (in)Justice is dirty. I look for bad things from her.

Impeachment of who, Obama or Kagan (or both)?

Hey, why not throw all the Jello at the wall, and see if any sticks? :tongue3:

(But seriously, there's probably nothing impeachable--yet. Although with Kagan, It's likely only a matter of time before all manner of unconstitutional decisions start flowing...)
