Missing handguns

Two Syracuse police officers (married to each other) went on vacation.
They hid their weapons in a closet.
Someone came in, found and took the weapons.

Since the weapons were not locked up, the licence was revoke
though both remain of the force.

Was that decision good, bad or indifferent?

Did they violate state law or did they violate department policy?

Storage of weapons for LEO’s is really important. It sounds like they were punished according to violating policy, rather than state law.

If they violated state law, they should be terminated.

I am not sure what the State law is off hand about locking up a weapon in your own home.

The individual who stoled the weapons has been arrested. Evidently he sold them as well.

Glad they caught him. Do they still have to post bond in upstate NY? Unlikely they will ever recover the weapons unless they find them at a crime scene.

Sorry, I should have given you an update.

From the link, two police officers, living together, went on vacation. They hid their weapons in a closet, including a department issued 9mm. They left a relative to house sit for them. While they were gone, a nephew visited, found the guns, stole them and sold them. The crime was not discovered until the couple returned home.

The police department has done very thorough investigation, referring nephew to juvenile authorities and recovering one gun. All of the guns were sold several times and may have actually left the state. The department issued gun has not been found.

The department is attempting to decide if they violated policy in the way the guns were stored. State law does not appear to be involved.

The idea that citizens can forfeit their second Amendment right to bear arms, because they do not store them according to government regulations is ludicrous. When I was young, people displayed operational weapons in plain sight, such as in the back window of a pick-up truck.

That is not the issue in this case. The issue is whether LEO violated department policy on storage of department issued weapons.

They aren’t losing 2A rights, but they might lose their jobs.

There’s an internal investigation by Syracuse Police into whether department rules requiring officers to lock and secure firearms in their homes were violated.

Syracuse Police members can also be held civilly liable for negligent storage of a firearm, according to the department’s policy.

Both officers are still on active full duty with the department, SPD said. But, one of the officers has had their personal gun license revoked for leaving the pelican case unlocked.​

I attempted to review New York gun statutes.

I believe the link is referring to a concealed carry license not an “ownership” license.

So, I don’t think they lost their 2A rights, but the right to carry concealed.

I googled New York gun laws, found the statutes and read through a summary of them. The site dealt with carry concealed rules which specifically mentioned proper storage.

I found nothing about loosing 2A rights for improper storage. It’s not there.

I access this site by phone and haven’t figured out how to link to sites yet.

Yes, and I heard on the radio that SCOTUS has ruled that 2A makes concealed carry licenses unconstitutional. I do not recall the designation, but it was an AM station broadcast over Southern California. :)
