A Raleigh County judge recently declared an Eccles man the lawful owner, by adverse possession or "squatter's rights," of a 25-foot section of property which previously had belonged to the Eccles Community Church.
The church's pastor, Steven Stover, said they were devastated by the ruling.
You just don't ever dream someone would sue a church."
He said the 25-foot loss "destroys the lot," not only for the potential construction of a community hall, but also for the additional parking needed at heavily attended church services.
"This is devastating to us. We're looking at possible relocation ... There's no way we can stay where we are currently and grow."
According to court documents, James M. Bolon is the owner of Lot 18 in the subdivision in Eccles, and the church is the owner of Lots 19 and 21.
The property in question, Lot 19, had been owned by Eccles Community Church since approximately February 2002. The lot includes a paved parking area, a paved driveway and a level grassy area; however, the court documents said the parking lots were not utilized until Stover became preacher around November 2011.
Bolon has used the lot over the years to store vehicles and equipment, and has mowed the grassy area at no cost to the church.
Judge John A. Hutchison ruled Oct. 22 that Bolon is the lawful owner, by operation of adverse possession, and the church must execute and deliver a deed to Bolon for the specific 25-foot area within 90 days.
