No. I think Congress should pass a law making it illegal for people not to use the common sense that God gave us! Then we wouldn't need all these other laws... :laugh:

Yes, there should be a new citation, "jaytalking." If you hit someone while driving bacause he wasn't paying attention, texting, then if he was violating the law, that may help your case.

It should be illegal to use a cell phone while driving. No one can talk on the phone and pay full attention to their driving. I also can't understand people who can't drive and talk with someone in the car without looking at them. They take their eyes off the road, but can't they talk without turning their head? I can.

I for one don't think it should be illegal to talk on a phone while driving...

Dialing, yes.. but answering a call, no...

If a person is so uncoordinated that they cannot talk on a cell while driving, they should not have their license...

No different from changing stations on the radio.. or putting in a CD, and finding a song... or eating a hamburger you just got from a drive thru...

What is the difference between talking to a fellow passenger and talking to a person on the phone... especially if you have a bluetooth headset.

Yes. Just because you are not going to kill someone else in such a case (unlike, of course, texting while driving), it is entirely appropriate for the state to restrict behaviours that might cause you to harm yourself.

States are free to make any laws they wish that do not contradict the Constitution. But, I am opposed to making a law against cellphone usage or texting while driving. First, how do you prove it? Second, no amount of laws will make someone use their head for something other than a hat holder if they don't already choose to do so. Third, there are a thousand other things (eating while driving, drinking a soda, playing with the air conditioning or radio, putting on makeup) that are just as dangerous as cellphone usage or texting, yet no one is clammoring to outlaw these. I do not think people should text or make calls while driving. However, more legislation is not the answer IMHO.
