Catching enemies on the battle field and holding them until the end fo the war is common practice in any war throughout history. Reducing war combatants to civilian crimes is not. But when you sympathize with the enemy then you want to do everything you can to assist them.

mp always to bame everyone but the actual guilty party.

MP does have a point though. In this war on terror, we aren't fighting a traditional country versus country war. In one of those traditional wars, you may hold POWs until the end of the war, release them and everything will be ok. Those POWs will go back to their countries, the war is over, and they will resume their normal lives. In this war on terror, there will be no end. The people we capture are not going to go back to their country and resume a normal life. If they are released they will just be angrier than before and go back to causing terror.
The simple solution is to not capture anyone. Kill them on sight. -
But, but, but...
There is no war on terror, doncha know?
