MIAMI (AP) ...arguments stemming from a legal challenge to the ban can be heard next month, a federal judge ruled Tuesday.
The American Civil Liberties Union filed a lawsuit last week to stop the district from removing copies of "Vamos a Cuba" and its English-language version "A Visit to Cuba." The school board's June 14 ban also covers 24 other books in the same series about visiting other countries.
U.S. District Judge Alan Gold told the district to keep the books, saying he wanted to "hold the status quo" until a July 21 hearing.
"One way or another, these books are going to remain here until I rule on this case," Gold said.
While Gold did not specify that the books needed to be accessible to students, copies of "Vamos a Cuba" and other titles from the series remain in school libraries, district attorney Luis Garcia told The Miami Herald for Wednesday's editions.
The ACLU of Florida applauds Gold's decision, said spokesman Brandon Hensler.
"Vamos a Cuba," by Alta Schreier, targets students ages 5 to 7 and contains images of smiling children wearing uniforms of Cuba's communist youth group and a carnival celebrating the 1959 Cuban revolution. The district owns 49 copies of the book in Spanish and English.
A parent who said he had been a political prisoner in Cuba complained in April about the book's depiction of life under communist rule. Two review committees and Superintendent Rudy Crew acted to keep the book, but were overruled by the school board.
The ACLU and the Miami-Dade County Student Government Association argued in a lawsuit filed in U.S. District Court in Miami that the books' removal violates students' rights to a free press and that the volumes were removed without due process.
"The ACLU understands that this book may be found offensive by some members of our community, but the answer to offensive speech and books - according to U.S. law - has been and should continue to be to add more books and more information with additional viewpoints, not enforcing censorship," Hensler said in a statement.

And when an atheist pitches a fit that the Bible or other Christian books are in the same library, will your comments be the same when a judge allows them to stay also?
As much as I don't like a lot of the things in this country, we have to understand that to take away one thing WILL lead to many things being taken away, and some of those things WILL be things we as christian's would want to keep.

As a pastor I always talk with the parents of the children and let them know what is involved in our services, what salvation is, and what baptism is. We should not be going behind the parents back. -

Why stop at books? Let's petition to remove all the movies that have B Grade actors. Better yet, let's remove all the movies that don't have the ring of salvation at the end of it.
Why stop at movies.. Our next catergory Alex will be music, no, foods, no let's pick proper dress for $1000.
Don't you see? Just because we don't like something doesn't mean it has to be removed. If you taught your kids right from wrong, when they see a book on communism, they would know it's wrong and know why it don't work.
Teach your kids to think as a Christian, and the rest will follow. It's like the No Smoking commericals, where it has a parent and a kid and the annoucer is asking how many times did it take to get them to take out the trash, how many times did it take to get them to clean their room, etc, and yet, parents don't have the conversation about NOT smoking and then they wonder why the kids are smoking.
Teach your kids and no matter what books are in the library, they will know the truth.
You can't just ban everything you think is bad. Because what we think is bad, and what someone else in America thinks is bad I can guarantee you it's different.

Your hatred of anything you deem to be "communist" and your desire to ban books puts you in total agreement with the National Socialists of Germany. Remember, they were right wing also. Be careful where you tread. America should not go down that path. -

Well lets not ban communist books about Cuba that is directed at children and puts communism in a false light, but lets ban automobiles that do not get a certain fuel mileage. Lets ban developement that effects the habitat of the horny toed lizard, lets ban a business from putting up a new sign because an owl has nested in the old one, lets ban land owners from having the freedom to do with their land what they want to, lets ban fossil fuels, lests ban protesters from areas that baby murdering clinics conduct their crimes against humanity.
But not books that promote the destruction of American freedom. -
You are throwing other issues into the mix. Again, who gets to decide which books to ban? What happens when someone decides the Bible should be banned? Maybe someone thinks it is unfit, what with the murder, illicit sex, and what not.
Also, society should not be dumbed down to where everything is fit for a 5-year-old. Those who would ban books are very scary indeed. -

Yes I am throwing other items in this world that are being banned. Why is banning a book more scarry than anything else.
Some think that certain types of vehicles should not be manufactured. And have been successful in getting them banned. I do not think so. It is no different. Who is it that does the banning? Apparently our elected government. Under the influence of special interest.
My point is why is some forms of banning acceptable but others are considered dangerous. And by the way this communist book will be allowed in our public school system before the bible which has already been banned. -
Banning the other things on your list are banning actions.
That is the difference: ideas vs actions. -

The book is described as promoting whats his faces ideas in communist cuba as being what they are not. Anything promoting that dictator and his ideas fits that description.
