Sounds like a First Amendment issue here. I'm no Kerry supporter, but I see no defamation.
-
I just hope they are successful in getting Kerry on the witness stand and under oath. That would be a first, I believe.
-
I would still like him to be tried for war crimes.
Joseph Botwinick -
Actually, he should be suing the producers of the film, along with that bogus Swiftboat Veterans outfit.
-
I agree. And as part of his evidence, I think he should sign a standard form 180 and release all the facts and prove that he was totally legitimate. I wonder why he refused to do so last year. :D
Joseph Botwinick -
Right on Joseph!
-
MP,
bogus Swiftboat Veterans outfit
Bogus as in they didn't exist? Bogus as in they weren't on swift boats? Or bogus just because they didn't trust John Kerry and stood up and said so? -
-
I agree, Terry. As proof they were lying, I think Kerry should sue them, sign a Standard Form 180 and clear his good name. Of course, then again, there is the whole war crime issue.

Joseph...
-
So why didn't Kerry sue? The slander was, to me,either obvious or true. I believe it's because he absolutely cannot be placed on the stand and put under oath. That would be his complete downfall. -

A Kerry spokesman suggested the suit was designed as a fund-raising tool for the veterans foundation and others.
"This is simply more of the same smears and sleaze against a decorated Vietnam veteran from more of the same serial liars who disgraced themselves in 2004," spokesman David Wade said.
"It's too bad the truth doesn't matter to the right wing when there's a chance to fund-raise based on outright falsehood and slander," he said. -
I agree. And Kerry should sue them, sign the 180, and show the whole world what liars they are.
Joseph Botwinick -
Kerry will hire the smartest lawyers available to try to quash this thing.
Hope they sue Hanoi Jane next. Then Haden, et al. -

"I am irritated to be called a liar by the spokesman for someone who spent
less time in Vietnam than I spent being tortured. I would like to know what
was false when I said that I was interrogated in 1971, told about the 'Winter
Soldier Hearings,' told that someone had recruited my mother to be associated
with these people, and told that John Kerry organized it. Was Boris (my
interrogator) lying about Winter Soldier? Did these hearings not take place?
Was John Kerry not involved? And while the Kerry people are tossing around
frivolous lawsuits claiming defamation, isn't it defamatory to say that
someone is lying if you can't prove it?"
-- The Hon. James Warner, VVLF Board member and former US Marine Corps
Captain held captive in Vietnam for over 5 years
"Who is this pipsqueak press boy Wade to question the honor, statements or
credibility of veterans who took real fire and POWs who took real torture?
How dare he! How dare Kerry allow his taxpayer-funded office to malign
decorated veterans and call them liars. Of course, this is nothing new for
Kerry -- his public life stems from vilifying vets."
-- Mary Jane McManus, VVLF Board member and wife of former POW Lt. Col
Kevin McManus
Pipsqueak!! Ya gotta love Mary Ann McManus. -
Wasn't his testimony before congress under oath? -
It would be the first time on a witness stand, under oath, being asked questions by a hostile attorney.
He was not questioned by anyone who could be considered hostile in 1971. -
It seems as though this lawsuit is in retaliation to the ones a couple of vets filed against them for defamation.
Does anyone else find it laughable that this guy whose film's entire purpose was to slime Kerry and tank his presidential campaign should sue Kerry's campaign manager for "insulting" him? -
I agree. Kerry should sue them right away, sign a standard form 180 as evidence, and clear his good name, thereby proving once and for all that all these POW's and Vets were lying.
